Prosecutor delays prosecution of surrogacy doctor

BANGKOK: -- The state prosecutors have put on hold the prosecution of a doctor on surrogacy cases after considering that the case file submitted by the police has not enough evidence to pursue the case in the court.

The doctor and owner of the All IVF Clinic, Dr Pisit Tantiwattanakul, faces two charges in connection with the surrogacy cases provided for a Japanese father.

The Lumpini police charged him of operating a medical facility without proper documentation and neglecting to supervise medical personnel at the clinic to abide by medical professional regulations.

A special prosecutor of the Sixth Regional Court, Mr Charoendech Salyapong, said Dr Pisit has petitioned the prosecutor for justice with reason arguing the police’s claim his clinic operated illegally.

Besides, the prosecution’s working committee has also studied the case file submitted by the police and found that evidence supported are still sceptical and had invited public health officials to jointly examine the file.

Later all agreed that it needed the police to investigate more to clear some suspicions.

One of such unclear point is where the surrogacy was performed as the clinic has two floors.
The prosecutor needed to know exactly the location where offences were committed.

The police were advised to return the case file back to the prosecutor on October 30 when on the same day the doctor is also ordered to appear before the prosecutor to hear the charges.
