Appeals Court drops Jatuporn's libel suit against former Democrat MP

BANGKOK: -- The Appeals Court today dropped the defamation suit filed by red shirt leader Jatuporn Promphan against former Democrat MP Watchara Phetthong for portraying him as a lackey of ex-premier Thaksin Shinawatra.

The court reasoned that the defendant’s remark was a political criticism which was made out of honesty and fairness and could not be interpreted as ‘tyrant’ as defined by the plaintiff in the suit.

The remark was not serious or inflammation to the plaintiff’s reputation and therefore not considered guilty of the charge, the court said and then acquitted them of defamation charge

Jatuporn appealed to the Appeals Court after the Criminal Court acquitted former Democrat Party MP for Bangkok Watchara and Mr Taweesin Sathitrattanacheewin, editor of Thai Post newspaper, and Sarn Su Anakot Co, Ltd, of defamation charge over Watchara’s remarks made on 24 September 2009.

According to the allegations, Mr Watchara gave an interview with the press at Government House commenting that Mr Jatuporn did not deserve to stay as an MP and should return his earnings to the state. The plaintiff also claimed that he was accused of telling lies and acting on behalf of self-exiled former Prime Minister Thaksin Shinawatra.

How did such an obvious dog of a case even get this far? Those people criticizing the courts are correct, the case should have been laughed out of court instead of even being heard.

The art of insulting someone while giving the impression to praise isn't really understood in Thailand. Somehow defamation is taken too serious, by law as well I'm afraid.

Now that's something one of those NRC committees should look into.
