Hello all, I was planning to return to the uk with my thai wife and our child. However, I wpoke to someone last night about this and he told me that his friend had done the same but he had to show he had savings of around 20,000 pounds to get the visa, can this really be true. I am well qualified and have worked all my life but savings aren't high at the moment, I don't even know if I could get to that level within the next year. I've looked on line about this but find much of the advice to be confusing. If someone could explain whether its necessary to have such a high amount I would be grateful.

Check;

http://www.thaivisa.com/forum/topic/689377-the-financial-minimum-income-requirement-for-partner-visas-for-uk/

It is income of £18600 that is required assuming the child qualifies as a British Citizen. More if not.

£62500 in savings if no other income or a combination of savings and income.

If you don't meet the requirements there is no flexibility and an application will be rejected.

Not much to live on for 3, especialy if one has to pay rent also.

Yet it is more than a British family of the same size living on Income support would receive.

However, members have argued about the merits or otherwise of the requirement many times in many topics; let's not drag this one off topic by doing so again here!

That is exactly what the government does not want

My yearly income is about 27k but my job will end in the summer, does that matter? Probably not right, since the job will end so that I can return home.

The financial requirement has to be met at the time of the application.

However, it will also have to be met 30 months later when she applies for FLR and again 30 months after that when she applies for ILR.

Although for those two applications her earnings can be used as well.

But:-

I get the impression that you currently live and work in Thailand; is that right?

Is the job which is ending your Thai job?

(Edit: I see from your edit that it is)

If so, then you will need to have been in that job for at least the 6 months prior to the application and have a definite job offer in the UK with a salary of at least £18,600pa starting within three months of your return.

If you do not have this, then I'm afraid that you will need to return alone, find a job with at least the required income and be in that job for at least 6 months before she can apply for settlement.

Though she could apply for a visit visa to accompany you, she could only stay in the UK as a visitor for a maximum of 6 months and would have to return to Thailand to apply for settlement.

Unless you can meet the requirement through a combination of savings and unearned income.

I suggest you read the link to the requirement above, and then come back with any further questions you may have.

I assume that this is a troll post, but just to put things in perspective, loans are not acceptable for meeting the financial requirements on a "savings" basis.

To which we have the reply:

I assume that this is a troll post,

Why?

There is nothing in the thread to suggest such.

I think Tony M responded to a subsequently deleted post. His post is the oldest surviving post in the thread that mentions a loan. Loose ends are difficult to avoid when deleting posts.

It was in response to a post offering loans as a means of meeting the financial requirement, not the actual thread itself.

Hi, I have been earning 27k for about a year now. Our child has a British passport. Regarding having a job to go into that might be difficult. I could get work over the summer but beyond that would be difficult to arrange before I arrive. I have some savings but not much. We are currently based outside Thailand at the moment.

Doesn't matter which country you and your family are based in and working in; if it is outside the EEA then you need to meet the financial requirement for your wife to obtain a settlement visa for the UK.

It seems from what you have said that you come under Category A: With current employer for 6 months or more – overseas sponsor returning to the UK.

If so, unless you have a confirmed job offer in the UK starting within 3 months of your arrival paying at least £18,600, can meet the requirement through Non-employment income or Cash Savings or any combination of these three then I'm sorry, but you will have to return to the UK and find a job which pays enough and be in that job for at least 6 months before your wife can apply for settlement.

Well, she could apply before this; but the ECO would have no option other than to refuse.
