the 3 or 4 real culprits are still running free.

If the 2 on trial are genuinely not responsible for these crimes, then the real culprits should right now be finding a way to take up residence in a country without an extradition treaty to Thailand. That is, if the real culprits did not leave the island the following morning on the first available ferry.

Ruling expected tomorrow on whether DNA evidence in British backpacker murders can be retested by an independent laboratory. #kohtao

So I guess that means the judge / judges accept there is a case for rechecking the DNA.

I fully expect the Thai forensic specialists will explain the British DNA alleged discrepancies to the judge's satisfaction, and he will accept the evidence without the need for independent testing. It would probably go something like this: The Brits did not have the full facts or complete samples or they tested the wrong ones or they were just observing not testing. Easy mistake to make.

I do hope I am wrong, but I get a sense that it is written in the stars...

If the UK has DNA that conflicts with the RTP DNA then I know which one I would believe

Start of trial over double murder of British tourists

KOH SAMUI, 8 July 2015 (NNT) - The trial of the two men accused of the murder of two British tourists begins today in Koh Samui.


Two 22-year-old Myanmar nationals, Zaw Lin and Wai Phyo, were arrested two weeks after Hannah Witheridge and David Miller were found brutally murdered on the beach on Koh Tao, on September 15, 2014.

The two claim that their subsequent confessions were made under duress.

The families of the British victims traveled to Koh Samui where the trial is being held, arriving on Wednesday. They have refused to comment on the case so far.

Attorneys for the two Myanmar suspects have asserted that there appears to be a discrepancy between DNA evidence held by Thai police and DNA samples tested by British police. Local authorities previously stated that forensic evidence, including DNA samples from cigarette butts found near the bodies, tied the men to the scene.

A verdict in the case is not expected before October.

Even the parents have arrived stating they are waiting for questions related to the deaths to be answered, and they hope that the guilty people involved can be determined.

Yes, I could have responded, but what's the mileage in having a meaningless debate argument. Now the Brits are helping the defence, and if independent testing of DNA is permitted, I'm hopeful the prosecution's case will founder on the rocks of truthful disclosure.

..........and if it doesn't and it confirms that they were the killers/rapists!!

Yes difficult to predict what this new evidence actually is but its obviously significant enough for Andy to call it 'important'. I guess we're not going to hear about it just yet as its the prosecutions turn at the moment?

Ah never mind.....we also never heard of 2 witness testimonies from the UK but luckily the defense team has heard and if true then at least we are getting some way to ensuring a fair trial

No apparently it was only provided within the last few days

In the runup to the trial, the Guardian has learned that UK authorities have now provided some information to the defence.

There has been a lot more advance disclosure from the British side. Andy Hall, migrants' rights activist “We’ve also had positive cooperation from UK-based witnesses,” Hall said. Hall refused to detail what information had been provided, which agency provided it or how it would affect the trial.

On the assumption that independent testing would be permitted if the alleged discrepancy is accepted by the court, it's logical to conclude that such a discrepancy if validated, would cause reasonable doubt. In other words, proof of a discrepancy that differs to the prosecution's assertions is sufficient - and that means it cannot match the B2.

How can we trust the crime scene investigation. Watch the news in Thailand. crime scene protection is a joke. Everybody walks arounds crime scene...Police officers and government official; with a lot of gold on their shoulders., any king of photographers from nwespapers., ambulance and rescue personnel even civilians,,,,, Investigation are often managed by hight ranking official that make declaration in newspapers....

I hope one day justice can be done for everybody and that police will be free from people in power to do their jobs....and not submits to the riches, the famous and the connected.

That's very rich of them to say when the defense team, and their proxies, have been busy for months disseminating and encouraging all sort of speculation and rumor mongering to hold the trial "on the court of public opinion" directly in opposition with the stated wishes from the victim's families.

The victims' families (correcting your apostrophe) are only one section of the injured parties in this affair, and their wishes do not in any way override the wishes of the international community, of residents in Thailand, of tourists in Thailand, current and prospective, and everybody else who wishes to see justice done -- many of whom know damn well that the process so far has been deeply flawed and that speaking out about it is the best thing to do to try to get justice done.
