For someone who continually preaches to us that you only deal with the facts, your beat up of locker room issues removes your claim to any moral high ground. Locker rooms are not the same as toilets. Toilets are public accommodations for bodily functions. Locker rooms are for different purposes. You want to talk locker rooms or you want to talk about schools dealing with trans teens, then at least be intellectually honest about it and not conflate the issue with the potty fear campaign.

Locker rooms, changing facilities, showering facilities are all under the responsibility of a management structure, whether public or private, whether effective or not. Those who manage such facilities have a duty to implement systems that ensure safety, quality and fairness to all their customers. I was staying in a resort in New Caledonia. Just wandering about. Walked passed what seemed to be a long window. Came face to face with about 5 women looking at me through the 'window'. Freaked me out at first then I realised it was actually a 'two way mirror'. I could see them but all they saw were their reflections. The facility was connected to the night club. I would estimate 95% of the activity was adjusting, stretching, straitening, eyelash check, mascara, brushing, tightening, lip stick, zipping, perfume spray. All pretty boring really. I do recall thinking man it is hard work being a woman all that frigging about. Pretty uninteresting really.

The reason North Carolina bill was passed in the first place was the Charlotte City Council voted to impose a regulation requiring businesses to allow a man into a women’s restroom, shower, or locker room if they choose.

It seems to me this whole problem has resulted from the fact that our definitions of what constitutes men and women have been blurred.

The solution to me seems equally straightforward. We must remove the label "men" and "women" from the bathrooms. Instead, have one bathroom for those with substantially functioning penises, and a second bathroom for those without substantially functioning penises. There is no discrimination then. It is a simple physical check. If you excrete urine/ejaculate from a protruding organ, then you use the bathroom marked for substantially functional penises. End of story. If you excrete urine/ejaculate from a recessed organ, you use the bathroom marked for those without substantially functional penises.

There is no room for equivocation here. It is black and white. If you are a transgender and want to use the bathroom designated for those without substantially functional penises, you simply surgically correct your issue. The labels of men and women have now been completely removed from the table, there is no more cause to claim discrimination, and at the same time nobody has to worry about their wives/daughters using a bathroom where someone with a penis could potentially harass them.

Again, it is the male/female gender label which is causing the problem. Drop that, and the problem vanishes. It is simply one of determining the kappa at the egress of your urinary tract, which is a mathematically definable quantity, and nobody should be embarrassed about their body, so nobody should have a problem with it. There is no longer any human consideration in the equation.

All we need now are standardized penis/no penis symbols.

Your legal rationale is entirely irrelevant. There are laws against sexual predators, inside or outside of bathrooms. There are no examples of trans people assaulting women or girls, men or boys in toilets. That you conflate sexual predators with trans people is promoting hate and bigotry. Turning an issue of minorities being treated equally and with dignity into a discussion of male sexual predation is promoting hatred and bigotry against such people.

There is no evidence of trans people assaulting women or children in restrooms. Direct your anger and fear at male sexual predators who ear dresses if you wish to occupy your time but that issue is entirely unrelated to religiously inspired legislation that discriminates against LGBT people.

He and his administration is defending the Civil Rights Act and it is the courts that will decide on this. Second, LGBT civil rights groups stopped trying to talk about other things and realized that we have to talk about the restroom issue. We have long known that the “bathroom predator” myth is just that — a myth. And we have long known that trans people are the ones subject to harassment and violence in restrooms. And of course it’s true that trans people have been using the appropriate restrooms for years without issue. But we finally started talking about all of that more openly and consistently, allowing people to follow their own individual journeys to a place of understanding rather than fear.

Third, we started responding directly to the other side’s assertion that we want to allow “men in women’s bathrooms” by explaining that transgender women are women, transgender men are men. This basic misunderstanding is at the core of the problem, and we have much more work to do to ensure that the country gets this basic truth.
