Child visa

Featured Replies

Me and Filipino gf (we are not married yet) are planning to stay in Thailand for a long time (although leaving country from time to time). Now I am considering visa opportunities for us.

We also have small child (8 months old), we will take him with us.

So the question is, since I already know about our visa opportunities, but I don't know which kind of long-term visa we can make for a child.

What kind of long-term visa child can get? Something like non-O based on me or my gf long-term visa? Then what kind of long-term visa is required for that (for example, is non-ED (student) visa is ok)? Or is there other opportunities?

There are no long term visas obtained at an embassy or consulate you can qualify for unless 50 or over.

If you find work or attend school you can get extensions of stay at immigration that can be for as long a one year.

If you or your wife were to get extensions of stay your child could get an extension as your dependent.

Ok, in fact it is not limited for 1 year, but as long as you continue your study and school will provide documents for extensions you can extend.

Anyway, so they will extend for child also based on this extension, right? But what type of visa child should/can have to ENTER the Kingdom in this case? For example, if my gf will enter based on non-ED visa?

They would of course have to get married first as they are not at the moment.

Why is that? Both of us are parents specified in his birth certificate. He can "depend" on any of us.

Your child needs a visa to enter the country and once he is here he should have a valid permit to stay. However, some parents don't bother renewing their child's permission to stay as under 15 year olds cannot be fined for overstay or banned.

As said above, once you or your wife have an extension of stay your son can get an extension as your child. Your son will need a Non Immigrant 'O' visa which would give 90 days on entry and could be extended within the last 30 (maybe 45) days.

But in that case it should be based on my or my gf long-term (not tourist) visa as we are both not Thailanders. Am I right? So the question is what types of visa can be base for his non-O visa? Or any better than tourist visa?

The Embassy/Consulate should issue a Non 'O' to your son as long as you or your girlfriend are getting any Non Immigrant Visa.

The length of an extension depends upon the the type of school. For informal schools such those for studying Thai they are only for 90 days and can only be done for  to a total stay of one year that includes the 90 day entry from a single entry non-ed visa.  After that year a new visa must be obtained to stay longer. If attending a formal school such as a university the extension can be granted for one year at a time and another extension can be applied for after that.

Your  child would be able to get a single entry non-o visa that would allow a 90 day entry that can be extended up to the date yours ends.
