Trump weighs revised travel ban, Supreme Court test still possible

ABOARD AIR FORCE ONE/WASHINGTON (Reuters) - President Donald Trump said late on Friday aboard Air Force One that he is considering issuing a new travel ban executive order, while White House Chief of Staff Reince Priebus said the administration could still escalate a legal dispute over Trump's original travel ban order to the U.S. Supreme Court.

In a step that triggered the most serious legal confrontation yet for the new Republican administration, Trump two weeks ago issued an executive order banning entry into the United States by refugees and citizens of seven Muslim-majority countries, triggering nationwide protests and legal challenges.

A federal judge in Seattle last week issued a temporary restraining order putting the travel ban on hold. That suspension was upheld by an appeals court in San Francisco on Thursday, raising questions about Trump's next step.

In a surprise visit with reporters aboard Air Force One en route to Florida from Washington, Trump said he was considering "a brand new order" that could be issued as soon as Monday or Tuesday if he decides to move in that direction.

After a White House official said the administration was not planning to escalate the legal dispute to the Supreme Court, Priebus told reporters late on Friday such a move was still possible.

"Every single court option is on the table, including an appeal of the Ninth Circuit decision on the TRO (temporary restraining order) to the Supreme Court, including fighting out this case on the merits," Priebus said.

"And, in addition to that, we're pursuing executive orders right now that we expect to be enacted soon that will further protect Americans from terrorism."

Trump's order, which he called a national security measure meant to head off attacks by Islamist militants, barred people from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entering for 90 days and all refugees for 120 days, except refugees from Syria, who are banned indefinitely.

Trump could rewrite the order to explicitly exclude green card holders, or permanent residents, said a congressional aide familiar with the matter who asked not to be identified. Doing that could alleviate some concerns with the original order expressed by judges in the 9th Circuit court where it is being tested.

On Air Force One, Trump said regarding the 9th Circuit court fight: "We will win that battle. The unfortunate part is that it takes time statutorily ... We need speed for reasons of security."

An official familiar with Trump's plans said if the order is rewritten, among those involved would likely be White House aide Stephen Miller, who was involved in drafting the original order, as well as officials of the National Security Council, Justice Department and Department of Homeland Security.

Independently of the Trump administration, an unidentified judge on the 9th Circuit requested that the court’s 25 full time judges vote on whether the temporary block of Trump’s travel ban should be reheard before an 11 judge panel, known as en banc review, according to a court order. The 9th Circuit asked both sides to file briefs by Thursday.

Many on this forum have opined that Trump would easily win this challenge in the courts. Seems they got it wrong. I do expect to see another attempt at a ban on Muslims from various countries entering the US via a revised Executive Order, mostly because this was a foundational campaign promise and not something Trump would want to go back on. However, it is my opinion that any ban will likely be struck down, primarily due to Trump's own rhetoric on the campaign trail. Trump's habit of engaging in a "Ready, Fire, Aim" approach to rhetoric is going to perpetually be his biggest undoing. He's his own worst enemy. On countless occasions, Trump specifically promised to ban Muslims, not Middle Easterners. Rudy Giuliani counseled Trump on how to craft the ban in such a way that it would not appear to be a ban on Muslims but still accomplish that goal. Trump has specifically stated that the ban would give preferential treatment to Christians. All of these factors are admissible as evidence and will go a long way toward undermining this administration's efforts at initiating a successful ban based on any claim that such a ban is not discriminatory. The fact that they are hesitant to take the current EO before the Supreme Court says a lot.

He wants to vet them for 90 days?   It takes 18 - 24 months to vet them now.

I am all for Trump issuing another ban as long he has learned his lesson and it fits within constitutional boundaries.

However, if it doesn't include Saudi Arabia, he's still a complete lying numpty.

The Donald will give his next travel ban much more thought (maybe) before implementing.   Well, I should say Steven Bannon will give it more thought and Kellyanne Conway will come up with better Alternative Facts (falsehoods) to sell the ban to the public.

Trump Has No Choice - He Must and Will Go to the Supreme Court.

After all - Who is running USA?  POTUS and Congress or the Liberal Courts.

 

The 9th circuit Court has been over-ruled by SCOTUS so many times it is almost a certainty.

And definitely a certainty once his SCOTUS nominee is accepted.

 

But in the meantime he will continue to 'play' with the Liberals and probably re-issue the ban with better wording this time.

Meanwhile the indignation and abuse and blocking will continue by the Liberals - despite Obama doing the same for 6 months.

 

You think the American People are not wising up to this hypocrisy from the Liberals and are not turning against the Dems more and more? Keep watching folks - the show has only just begun.

I doubt Trump will take it to the supreme court because it would just be another embarrassing loss for him.  Much more likely that he will do a re-write.  If he included the main offending countries (like Saudi Arabia and Egypt) then he would have a much better chance of getting somewhere with the judges.

 

As erratic as ever he appears to be rolling back some of the vitriol and backtracking on his confrontational campaign rhetoric.  Not sure how his fans will feel about that?  Maybe he starting to realise that he cannot let his mouth run wild like it has.

Team Trump knows they have to deport and reject a whole lot of people and want SCOTUS decision defining their authority beforehand. They could have ignored Robarts, he is a district judge. Instead they are taking it to SCOTUS

"They could have ignored Robarts"..Really?  Why stop with Robarts? Why not say they can ignore the Supreme Court, too? It's clear you have no understanding of the powers of the judiciary branch of government.

This whole Trump bashing and Trump defending thing is getting really boring now.  We are all scratching about when really nothing either side says will sway people one way or another.  I find myself repeating the same stuff over and over in different threads.  There is only so much mud being thrown that actually sticks.

 

I suspect that the circus will crawl along for a while but until something substantial happens I think I will refrain from commenting

The Trump Hammer cometh?  Maybe Donald will be staring in the next Thor sequel movie?  But I don't think Donald wants to use his hammer again too soon after he smashed his fingers with his travel ban hammer.

Not in the The 9th Circuit. They are notoriously biased and eighty percent of decisions by the Ninth Circuit were overturned when escalated to the Supreme Court. Most probably that is where this will end up, but likely not before Trump comes up with a new bulletproof executive order to solve the problem much quicker.
