Cambodian police announce arrest of British man wanted over murder of Tony Kenway in Pattaya

 

Cambodian Police have officially announced the arrest of a British man suspected of being involved in the killing of Tony Kenway in Pattaya.

 

On Wednesday, Deputy Police Chief Gen. Chhay Sinarith confirmed the arrest of Toby James Nelhams, who is being held at Phnom Penh Municipal Court.

 

Nelhams is one of three men wanted by Thai police in connection with the murder of Tony Kenway as he sat in his car outside Sanit Sports Club on January 24.

 

Kenway had previously been described as a website designer, but Thai police said he had connections boiler room gangs and ran an illegal gambling website.

 

Last week, Thai police said they believed Kenway owed Nelhams 8 million baht and this could have been the motive for the murder.

 

On Monday police denied an earlier report that Nelhams had been arrested and was due to be sent to Thailand.

 

However, it is believed the official announcement today of the arrest of Nelhams will lead to him formally being handed over to the authorities in Thailand.

 

Thai police have also identified two other suspects South African Abel Bonito Caldeira and Miles Dicken Turner from Britain. 

 

Both are believed to be hiding in Cambodia.

I'd be very surprised if this guy ends up in jail. He seems to keep a low profile, especially compared to the others, and it's hard to believe the RTP would have hard evidence that he ordered the killing. Maybe if the others are caught they will rat him out but this seems less likely as each day goes by. They aren't even on the Interpol register yet.

If true, congratulations to the Cambodian cops. I say that because the RTP will say that it was basically all done by them (just like when they lifted that bloke for the BKK bombing without any tip offs from anyone........)

 

But the trigger man and the getaway driver still MIA... I suspect this latest arrest can take the entire rap

I had a feeling that Factfinding was Toby himself. If not, a close friend doing a PR job. It will be interesting to see if FF posts more while Toby is supposedly arrested. 

 

I hope TheJackal returns to enlighten us. He/she seemed to know the whole story but only posted once.

I assume there is due process in Cambodia like a modicum of evidence before extradition of random foreigners to a country under military occupation?

I can not quite get my head around the illegal gambling sites in Thailand--the way Koreans fly in to run them, people are shot over them  etc.

For the people who use them why isn't it just as easy to log onto a foreign site...say the UK bet 365 etc and place the bets there ? it takes about a 1,000 baht (20 quid to open a account there) my friend who is a mad football nut done it last year.

If we are talking about other types of gambling sites---then they are just as easy to join re America etc. Had a friend who--years back who would play poker every night....always told me what a professional he was---had to go back and start work again after doing it for 2 years.

Seems to me Tony owed 8 million 5 thousand baht of business venture together with Toby and it is believed that business conflicts led to the murder .. Also Toby has a number of business venture here in Thailand / Cambodia.. Plus a cafe not too far away from the gym where Tony was executed .. But still there are two murders on the loose also it didn't help that  Toby enter Cambodia without any passport or identification plus working illegally in Cambodia and was arrest at a cafe at the International Airport in Phnom Penh on the 15th. He is now being questioned how he enter Cambodia by the immigration police.. Also RTP  and  court's capacity, That the department of the Interior Ministry to investigate and implement procedures nothing more at this stage to go by so far and Cambodia Police Department investigation and procedures Ministry of suspects presented to represent the prosecution for questioning procedures ..So all the RTP have is probable grounds for murder from my understanding .. also if found guilty by a court in Cambodia , he must serve the term of his punishment in Cambodia. Also after completing his sentence, he would be immediately deported from Cambodia if there was no request for his extradition from Thai police, It was  also falsely reported on Saturday that Cambodian authorities were expected to hand over Mr. Nelham to Thai authorities, with Cambodian police denying knowledge of the report on Sunday. Thai police had sought help from their Cambodian counterparts to hunt down several foreigners suspected of being involved in the murder of Mr. Kenway after they reportedly fled to Cambodia.

Alleged mastermind of Briton’s murder in Pattaya held in Phnom Penh

 

 

A Briton wanted by the Thai police for allegedly masterminding the murder of a fellow citizen in Pattaya last month has been held in the custody of Cambodian police in Por Sen Chey district of Phnom Penh, the Phnom Penh Post Online reported on Thursday.

 

Phnom Penh Municipal Court spokesman Ly Sophaya said the prosecutor was questioning the suspect, Toby James Nelhams, reviewing documents and evidences.

 

Nelhams was accused of hiring a South African and a Briton to kill Tony Kenway in Pattaya on January 24. The victim was shot dead in his Porsche and the two alleged gunmen and Nelhams were reported to have fled to Cambodia. Business conflict was believed to be the motive of the killing.

Bragging rights. I want to stay retired so I avoid these places besides the house wins most of the time. It they did not there would not be so many casino's around.

So far as aware, these websites are illegal because they don't have a licence and don't pay tax. They also offer services in countries where gambling is illegal. I believe that they pay out their customers like regular bookmakers do. The profits come from the savings related to licencing and tax and also through accessing markets that their legal competitors cannot. These sites are like a modern version of the Numbers game that the mafia used to run. 

 

You can access Bet365 and plenty of other gambling sites. But I doubt you can link a Thai bank account.

 

And yes, it's usually sports betting. Here's an Interpol report about the most recent phase of busts across Asia.

Nah iam referring to an article posted on TV somewhere that claimed the UK Government had blocked extradition (or words to that effect).

I recall it was a Nongprue cop who was reported as mentioning the blocked extradiction when Kenway's widow showed up at Nongprue police station with the media hoping to see Nelham some time last week. AFAIK, the UK Government hasn't said a dicky bird.

Toby is looking fit and healthy in the photos published here, a lot better than the last time I saw him a few years ago. I believe has been working on this.

 

He is smart enough to sit back with his mouth shut and wait to see what is presented as evidence whilst waiting to see what other opportunities present themselves irrespective of costs. I suspect there is more of this story to come.

According to the Thai-Cambodian Extradition Treaty, the two parties are obligated "to extradite to each other, in accordance with the provisions of [the] Treaty, persons who are found in the territory of one of the Contracting Parties who are wanted for trial, prosecution or for the imposition or execution of punishment in the territory of the other Party for an extraditable offence."
 
As part of the supporting documentation, the requesting party must supply "such evidence as would justify that person's arrest and committal for trial, including evidence that the person sought is the person to whom the warrant of arrest refers."
