Law on accessibility of river banks

The river bank itself is government land. We live an old mooban of 10 house, along the river, only 1 access and 1 dead-end road. For many years people in the village behind our mooban would come for fishing. No trouble ever!

Mooban owner went bankrupt years ago, i.e no manager. I like the villagers to come for fishing but suddenly an "important" owner decided to gate off the mooban. The gate works on remote. I.e. no villager can come in.

 

Is ist legal to restrict access to the river bank?

Any if someone can help with a Thai copy of the relevant law that would enable me to talk.

Access to the river bank hasn't been restricted.  The river bank is still accessible via the river.

Go ask at your local Police station, doesnt really matter what "the law states" as they are the ones who will decide what is or isnt appropriate etc.

I would if the villagers would also speak up for themselves. If I'd ask them to come along = Mei Pin Rai will be the reaction We are too low.!!

Is the road a public road or not ? If the road is a public road the person blocking the road is breaking the law. If however the road is part of the owner's land (person with the gate) then he has a right to block the road. Saying that, according to Thai law if people cross your land to access their land or use it as a route for more than 10 years, they obtain the right of way. To use this law however may lead to a court case, which I presume this person blocking the road knows. I think you must look at the ownership of the land going to the river bank and not the river bank ownership.

If I'm interpreting this correctly, "Mooban" (or Muban) means village or hamlet. You're saying that you live in 1 of 10 houses that make up the whole of this village and the owner of the land that the village was built on has gone bankrupt years ago. (begs the question; To whom have you been paying rent to?) Now, some new "owner" has shown up and put up a remote controlled gate blocking access to the entire village or just the "dead-end road" after it has passed through the village but before it reaches the water?

IF the people doing the fishing are from a separate village, the new owner MAY be trying to secure some kind of "fee" to his/her "fishing rights" (as perceived in the mind of a Thai owner).

So, why not enlist the help of your fishing friends, grab some machetes and hack a new path around your village? You get your fishing friends back and the owner can't do anything about it.
