Police seek extradition of former abbot applying for asylum in Germany

Thai police have sought an extradition of former assistant  abbot of Wat Sampanthawong Phra Prommethi who is reported to be seeking political asylum in Germany, Deputy Prime Minister Gen Prawit Wongsuwan said on Monday.

 

He said national police chief Pol Gen Chakthip Chaijinda, has followed the required procedure to seek the extradition of the former monk but admitted that the process was stalled.

 

He said he didn’t know the reason behind the delay since Thai police have followed all necessary steps in accordance with the law.

The request for extradition must be

presented to the German court within 40

days from the date of arrest (Article 16

para 4 of the CoE Convention on

Extradition)

 

Also have they read this

 

Standard procedure:

If the person sought does not consent to his extradition, the Higher

Regional Court has to decide if the extradition is to be allowed.

Then the extradition has to be granted by the Federal Office of

Justice with the consent of the Foreign Office and other Ministry

whose portfolio would be affected.

 

Not an easy task as German Bureacracy is horrendous!!!!

 

Also if the person requires Medical treatment then the German Courts will not allow Extradition due to the fact that good medical treatment might not be available in the prison, this happened in 2016 when Thailand tried to extradite someone from Germany.

Don't be too negative. There has been one positive out of all this. They are making Thailand's leadership appear as complete and utter fools; not only on the domestic scene but on the international stage as well. The loss of face must be galling for one certain individual.

They have collectively made a complete stuff-up of the operation. When Mr. Grumpy returns home from the UK some heads are sure to roll, with one notable exception, that being the ugly head of buffoon Prawit, the man in charge.

Which Thai ministry would be responsible for submitting a formal extradition request? (I don't believe one has been submitted - they are always claiming to have submitted extradition requests when they actually haven't)

 

I would have thought it would not come directly from the Thai Police. It may be dealt with by the Foreign Ministry and / or the Interior Ministry. Not sure why the press are asking the National Police Chief unless they have been sent there by Prawit.

 

Sounds like Prawit and Chakthip are playing a game of pass the [unwanted] parcel with this case. It's all downside for them. They don't know how to get him back, they can't get him back, they won't get him back, it all costs time and money for no result but neither of them wants to admit to failure, accept blame for failure or admit they can't do it so they try to push it away by claiming to have done everything possible (they haven't) and saying it will all be sorted out soon (it won't).

Possibly because the deputy prime minister in charge of the whole business is a General who obtained the post as the result of a military coup?

 

That often stalls extradition requests which are dealt with by the independant courts of democratic countries...

But is there really a delay? Didn't we read about a week ago that the German authorities told them the process could take up to 2 months? I do like how someone mentioned an independent German court has to look into it. So long as the Thai government followed all procedure, it's just a waiting game, the process has not been stalled, as far as I understand. Upo to 2 months = up to 2 months, not in 3 days like you want. Governments all over the world, want what they want right then and there, but can't give others the same - example of the guy who posted about his waiting time of 5-7 years to become a thai citizen.

No, they don't. I guess not fleeing to the US or the UK, who both do have an extradition treaty with Thailand, was a smart move.

 

However, under the principle of reciprocity in extradition, requests for extradition may be made by states which have no treaty of extradition with Thailand. But these states must clearly express a commitment to grant extradition of fugitives required by Thailand in a similar manner when requested. This being the case, extradition requests will usually be considered from states with no formal treaty on an ad hoc basis.

It is my understanding that the asylum case would first need to be settled before consideration could be given to the extradition.

Perhaps the Thais could present a case at the asylum hearing. I do not know if this is possible.

asking germany to send him back,yet brother and sister and they know where they are not on the list to send them back or detain them for them to be collected.this is thailand i suppose

As JAG said earlier, will anycountry with a democratic government and respected court system send some one back to a military dictatorship? Britain wouldn't.

His request for asylum will add a lot more delay time while it is considered. It puts the extradition request on hold until decided.

That would involve knowing the procedures first, thinking, planning and coming up with a logical process.
