So me and my girlfriend has just moved to Nonthaburi and we are having some stupid issues about her not being able to change her adress in tabian baan.

 

We have rented a condo and after living here for about 3 months now my girlfriend has some issues so that she has to go to hospital a few times every month for the next year or so. Its not serious but she has to go and since she didnt change her tabian baan yet she gets a bigger bill than she has to. So we want to change it.

 

We took the contract with us to the office, but when we arrived they told us that we cannot do it without the owners coming to the office together with us.

 

So we called the owners, and they refuse to help us with this, they dont want her to be listed as a resident in this condo.

 

Can they really refuse us this?

 

It sounds very weird to me.

Anyone know of any possible to solution to this? Or is there litterarily nothing we can do?

Not that crazy, if you rent condo's out as an owner you would get a lot of additional work to put people in the blue book and remove them again when they leave. For 1 condo not too much problems but when you have a 100+ it is a major headache. There are people who have friends in the neighborhood with their own house who are willing to put somebody on their blue book.

Without the co-operation of the house master (the owner) this is likely your only route.

The law says that upon change of address (moving out or in), the amphoe has to be notified within 15 days, failure to do this can be fined.

This law is usually not enforced in any way, but it does still exist, so the question is what happens if you file a police report.

But in case of filing a police report against the condo owner it could happen that your girlfriend, or the housemaster of the place where she is registered (probably her parents) will be fined as well, because they didn't register her moving out within 15 days.

 

If it's important for a Thai to be registered in the house book, this should be made clear in the rental contract.

If you own a house, there's a lot of stigma in having unknown people in your housebook, if they're in debt and had court orders, it would be posted to the property or that residence will be where private debt colectors and bills are posted to, that is the main legitimate concern.

You would also need to give them access to the housebook or photocopy of it from time to time when they need it for various transactions. In practice, kicking tenants out of the house book is a simple process, but it's another step of red tape that for short term rentals, most landlord would rather not deal with.

 

then the question to the landlord is not 'Can you put her name in the house book' 

but 'How much to put her name in the housebook' 

 

For Thais without house ownership, normally they'd have their name at a relatives' house somewhere, without access to a housebook and being put on the 'central registry book' means you're effectively homeless and unable to access many services from banking, fiance to healthcare and education.

 

For long term rentals, some renters get to have the blue book, putting the tenant as head of house also protects the landlord, as if the tenant does anything illegal like gambling or drugs bust, the head of house on the book is on the hook for it, it is also their responsibility to move people in and out of the book.
