Forced to leave thailand and want to close corporation but being scammed by accountants

Italian citizen who hired accountant several years ago to create corporation to sponsor for B visa for several years.  It all worked well until month ago and they accountants said they couldn't renew work permit.  So work permit expired.  And B visa now expired.  The accountants really messed up this one and dropped the ball by not doing any of the paperwork that they should have done.  So I had to leave and do aborder run as 90 days was to expire.  I left and went to Malaysia but now not allowed back in to Thailand because no resident visa and Italians no longer allowed visa free access.  I've booked a flight and leaving tonight for Argentina.  No plans to return to Asia or Thailand.  I'll stay in Argentina for the foreseeable future until all this visa stuff blows over and then try to return to Europe.  No desire to return to Thailand.  Maybe I'd come back to visit some friends in a few years, but no  definite plans.  Anyway, the accountants who dropped the ball on this one now are sending all sorts of bills and invoices.  I just want them to disappear and go away.  I emailed them and told them to close it and now they want 20k for this and 30k for that and 20k again for some other BS.  I think it's all a scam. I am happy to pay for a job well done but refuse to pay for a job not done.

 

a.) like in almost every other country, can't you just let a corporation lapse by not renewing its annual fees and then it just folds/collapses administratively because its license is no longer valid?  Is that a thing in Thailand? That’s what I told them to do.

 

b.) in addition, they say that me, as director, need to come back and travel 4 hours away to Surat Thani to file some papers.  

Isn't that what I pay them to do?  Again, I have no way or intentions to return to Thailand at least for a few years, quite possibly never.  Even if I wanted to, as I tried yesterday, I'm not even allowed in the country. So why can’t they do this? Isn’t that their job?

 

c.) If I just tell them to F off and put their email on a spam filter to my trash can and simply ignore their fee collecting efforts, is there anything illegal or even amoral about that? I don’t think so but maybe someone else has another opinion. does the corporation lapse or otherwise expire? I once had a marshalls island corp closed because I didn’t receive the renewal notice in the post and therefore didn’t pay it. The way I found out about it is when I tried to log into the the bank accountant and find  it was closed and called the bank and the was the one that told me that the corporation had been closed over a year ago. It was news to me. Does Thailand work the same?

When were you denied access and at which border or airport?

 

I'm surprised they're not allowing any Italians in, I would have thought there would be a 14 day exclusion period if you've been in Italy. Could you have got a different type of visa? Like a tourist visa?

 

This seems overly harsh and doesn't in any way achieve what they're supposedly doing here which is limiting spread of this new virus.

 

Can't help you on the company issue but I wouldn't pay them anything, especially if I had no plans on coming back, don't they owe you money for getting everything wrong and essentially completely changing your life in every way imaginable due to neglect?

 

In any normal country you could sue them and expect to win and have them banned from practicing law but this is not a normal country, not by far.

 

Good luck in Argentina, I haven't been there for a long time but it seemed quite nice the last time I visited.

It is a lot more difficult and expensive to close a company in Thailand than it is to open one. I have done it several times.

 

If I was in your position I would ignore any further correspondence and forget about it.

I remember a thread about a similar situation and the company is eventually closed. Maybe you could search the forum using Google and adding this filter: "site:forum.thaivisa.com".

Yes.  It was revoked 2 days ago, then resumed yesterday, then revoked again today.  Lots of flip flopping muppets.

The airline wouldn't let me board from KL to Samui. And, yes, contrary to the reason and possibility.   I flew out with a B visa and wanted to come back as a 30 day non exempt tourist.

 

Yes!  I completely agree!  Not only should I not owe them money but in my opinion they should be fully help liable for professional liability and beglect and malpractice and giving bad advice that has cost me hundreds of thousands of baht!  But this is Thailand.  Good luck.  They're Thai and I'm not even allowed to enter the country.

Thanks.  The wine and food will be a million times better, and cheaper too.  I can't wait!

I was there last summer, but not that it matters.  Common sense isn't very common when dealing with the bouncers at the border and airline check in counters.

Well, look on the bright side - your business in Thailand is done and you have the wherewithal to relocate to the Argentine - win/win!

I would tell them to "go forth and multiply", without using that many words of course.

Tell them if there are any fees that absolutely have to be paid, they can do so from their own pockets to make up for their total incompetence.

They are not going to be able to come after you, so give them nothing. 

Well, you can give them some additional abuse into the bargain if you so wish.

In any normal country, accountants wouldn't be practicing law!

You weren't "forced to leave Thailand", you left voluntarily to do a border run!  Maybe you should change the OP title.

 

What, specifically, is the "scam" that you claim they are perpetrating?  Charging you for accountancy services?

They not even let Italians in at Mae Sai right now. Could be more countries on monday, I re-enter for that reason tomorrow.

Hehe usually the way it works at Mae Sai is that they won't let you out if you can't get back in. You can then go to Huay Xai border instead and enter Laos (about 2 hours apart from each other), where the only way to get to Vientiane is a 24 hour bus or a over priced propeller flight on a half baked airport near a cliff lol. Happened to me before, took the flight. 

Some things are not clear . OP said company was opened to get the non b and WP , does not say company was actually trading or legit.

 

why could they not renew WP? What was the reason given ?

 

without WP but being company director , one can obtain Non B single or multiple entry from Malaysia .

 

i have a feeling.  It was just a shelf company to get visa and WP for visa extension . These days they authorities check everything and perhaps why WP could not be renewed

Pretty much sure as OP would else not depend on a specific accountant to get his paperwork done. Neither a mention of staff.
