Family want 19 million baht damages from Nok Air after death of employee

The family of a 27 year old man have filed a complaint with the civil court for 19 million baht damages after he was killed while working for Nok Air.

 

He was driving a pushback tractor or tug used to move aeroplanes when he was crushed by an aircraft. 

 

He was seriously injured and later died. 

 

The accident happened on February 7th of this year and since then it is alleged that the company has made no contact with the family to settle, said chief of the Lawyers' Association Narinpong Jinaphak acting on behalf of the family.

 

There are concerns that the statute of limitations on the incident of one year will run out leaving the family with nothing.

 

So on Thursday the claimants went to the civil court in Ratchadapisek, Bangkok to file a suit. 

 

Narinpong said they could wait no longer.

 

The police investigation has gone nowhere, he said, and representations to the Justice Ministry have failed to bear fruit.

In any other developed country, a workplace death caused by equipment breaking would give lawyers an open goal to obtain significant compensation for the family.

There are ways to go about seeking and getting compensations for a wrongful death and the Thai laws allows for it, but between airline company lawyers and the police lackluster attitude like investigating the case not much will come out of it, however a good honest lawyer can get this case going, easier said than done...

Wow, there's a shocker!  

 

BTW, I believe Nok filed for bankruptcy protection the other day....following the lead of Thai Air....  So it would be interesting how any civil litigation would fare during that process.

Unless the poor guy had significant hospital bills it is difficult to justify a claim for 19m baht for someone who tows aircraft. His salary can't be very much. Even at 30k a month that is only 360k a year 20 years salary would be 7.2 million. 19 million just seems too much to claim

30k per month is optimistic for a driver. Even 15k I would be surprised.

And don't forget in developed Countries the Company would have mandatory insurance in place anyway!!????????????????

Companies like this usually have mandatory insurance for cases like this and compensations are regulated.

19 million for an accident at work in Thailand seems a bit high though.

Unless there is evidence of foul play, "police" don't normally get involved in work related accidents. Insurance companies are the investigators. 

The lawsuit should wake them up.

This OP article pertains to Nok Air. It's also Nok Air that filed for bankruptcy reorganization this week, apart from the demise of Nok Scoot.

some US federal health and safety authority. the problem is, that the common americans haven't so much idea form the rest of the world, they are really thinking, their s##t is called everywhere the same. In Thailand must properly it should be the responcability of the Department of Labour Protection and Welfare.
Questionable is, why he has stopped with his tractor in front of the aircraft which he has pulled. From the video I would say, tractor operator mistake.

Yeah, I don't see his family receiving anything from this. Maybe one day, things will change, but that may not be for a while.
