My friend is an American in his 30's. HIs wife is also an American. For the past few years they both have had visas and work permits for teaching English at a school. The wife though never tought at the school even though she had a work permit. The school is now saying she needs to work at the school as well. This is practically impossible as she is raising the kids. If the husband has a work permit and visa through the school, does the wife need a work permit, or can she and the kids get the visa because the husband has a permit???????

Wife and dependent children dont need work permit if the guy is working and holding a valid work permit.

The husband’s work permit does not directly enter into the equation.

His wife and the children need visas.

However, if the husband has an extension of stay for employment, his wife and children can get extensions of stay as his dependents. The fee is 1,900 Baht per person.

If wife and children did not enter on a non-immigrant visa or are not currently on an extension based on a non-immigrant visa, they first have to change their visa status to non-immigrant. For this, they can apply at the immigration office. Fee: 2,000 Baht per person.

To avoid confusion, please understand the differences between the following:

– Visa: permission to travel to Thailand.

– Entry stamp (admitted until...): permission to stay in Thailand.

– Extension of stay: extension of the period of stay granted upon entry into Thailand or when last extended.

Thank you so much for your help. The school my friend is working at is telling him his wife needs a work permit also inorder to have the visa. I told him, like you guys mentioned that she doesn't need a work permit. Is there any documentation that he can show the administrator so that she understands this?

How old are the children?

Another possibility is for the wife to get an extension of stay based on the child(ren) being

in full time education in Thailand?

The children are only 3 years old and 6 months. They were both born here. For some reason the school made his children get visas as well, when I know children born in Thailand don't need visas until they are older. The problem is that the school is taking care of their WP and Visas, but the school doesnt really know the laws.
