Outrage as Thai rape sentence slashed in half, raising questions about justice system

A Thai woman and her boyfriend questioned the justice system in Thailand after a Bangkok taxi driver’s rape sentence was reduced from six years to only three years. The victim suffered both physical and mental health damage as a consequence of the sexual assault.

 

The victim’s boyfriend shared the story about his girlfriend on Facebook on Thursday, May 11. He disclosed that his girlfriend was raped by a Grab taxi driver and the rapist was imprisoned for only three years because he confessed and it was his first crime.

 

The victim’s boyfriend expressed his profound disappointment, asserting that such a light sentence hardly reflects the severity of the crime committed.

 

The female victim, whose identity will be protected under the alias A, spoke to KhaoSod after her story went viral on Thai social media. A revealed that she hung out with her friend in the Thonglor neighbourhood of Bangkok one night on November 30 last year. Her boyfriend could not pick her up because he was drinking with friends, so she decided to take a taxi home.

 

A explained that she booked a taxi via the Grab application and the taxi that picked her up was a green-yellow taxi car with a registration number 1มค8199. She sent the detail of the taxi driver to her boyfriend and notified him that she was on the way home before falling asleep in the cab.

 

When she woke up, A noticed that the driver was taking her in the opposite direction of her intended destination. Growing concerned, she questioned the driver about the unfamiliar route. To her utter shock, the driver responded…

 

“I’m taking you to a love hotel.”

I am not keen on the State having the right to mete out such punishments.... but if every day of the 3 years included a rape for him to endure, justice may have been served.

Yes cut it all off and 1 month jail or 15 years jail no parole.

No, they don't make it up. It's the Thai law. Confess and get it halved. We may think it's preposterous, especially in cases when the confession is totally irrelevant, but it's their law. On the other hand, look at the justice system of some first world countries and it's often just as crazy.

 

What is outrageous is that in a case like this he got only 6 years to start with. The jury should be composed of women who suffered rape, then it would be a different music.

A very tall order I think.

If they have to fix everything it will take at least 60 years..... a whole or maybe 2 generations.

Also because no violence and she did not fight back....

It is something different if someone beat the woman half dead or if it is without violence.

Wasn't there a case where an old couple were given a really long sentence for picking mushrooms?

Also another where a mother was found with about a tenth of a gramme of coke in her bag and given around 20 years.

 

Are there any guidelines for sentencing here?  Seems to be up how to the judge is feeling on the day, or how rich or well connected you are.

I think more like 90-100 years. This is England of the 1930's or even 1920's 'Yes yr lordship you killed someone with your big beautiful car but in mitigation you were drunk at the time/ You didn't maintain your machinery properly and someone died, but you are a decent chappie of good breeding, so let's call it an accident'.

I think it was only last year Germany changed their law on rape. Until then if a woman did not fight back it could not be classed as rape even if the man was holding a knife to her throat same in some other European countries
