Registering a vehicle in a person's name (on behalf of a charitable organization)

Featured Replies

Hello,

I am a member of a charitable organization in Thailand that needs to purchase a vehicle. I have checked,

and the charity can not put the vehicle in the name of the charity. It needs to be registered in an individual's name.

Are there any risks for a foreigner (on a retirement visa) registering the vehicle in her own name under

a letter of understanding from the charity that the vehicle will only be used by and for the charity? Once

purchased, a few Thai workers will drive this vehicle and it will be fully insured to cover other drivers.

Are there any risks or issues to consider in this situation?

Thank you in advance.

Is the charity registered as a Foundation? If it is then the Foundation as a juristic person can register assets such as vehicles under its name.

If the charity is not a Foundation then a letter of understanding or indeed any document issued in the name if the charity is not legally binding as the charity has no legal standing.

The risks of putting someone else's vehicle in your own name boil down to keeper of record offences, such as if the vehicle is caught on camera speeding and the driver cannot be ascertained. If the charity doesn't pay then the keeper would be liable.

That said there are two halves to this, and the charity is trusting the individual with possessor title of the vehicle, so one would hope they would fix small issues such as potential speeding tickets.

Easy answer, put the vehicle in a Thai persons name.

Don't leave yourself open to idiots driving it.

( plenty of them here )

Just don't do it.
