Popular Post webfact Posted July 12, 2023 Popular Post Posted July 12, 2023 EC sends Pita shareholding case to Charter Court Thailand’s Election Commission (EC) decided this morning (Wednesday) to send Move Forward party leader Pita Limjaroenrat’s iTV shareholding case to the Constitutional Court for consideration. The EC also asked the court to order Pita to stop performing his duty as an MP immediately, until there is a decision by the court in the next three days as to whether to accept the case for consideration. The EC, at its meeting this morning, agreed with its fact-finding committee’s conclusion that there is sufficient evidence to prove that Pita owned 42,000 shares in iTV, a media company, when he registered his election candidacy. The EC’s decision comes one day ahead of the joint sitting of the House and Senate to select a new prime minister for Thailand. In a swift response to the EC’s move, the Move Forward party accused the commission of not following its own regulations and, therefore, committing malfeasance in office, in accordance with Section 157 of the Criminal Code. For conservatives in Thailand, however, the unthinkable may be about to happen as the financial markets anticipate an investment rally if Mr Pita Limjaroenrat is elected by a joint session of parliament on Thursday. However, there are still reports that only 20 members of the Senate or Upper those will support the bid and apprehension that the country could be plunged into a period of political uncertainty and turmoil. After an appeal yesterday in the media to senators and MPs to support his candidacy for Prime Minister, the canvassing of senators and MPs continued on Wednesday with both the Move Forward and Pheu Thai parties executives working to drum up support for Thursday’s crucial vote to elect the 3oth Prime Minister of Thailand. At the same time, Move Forward officials and advisors to Pita Limjaroenrat are fighting a rearguard action to fight off a last-minute Constitutional Court intervention as the Election Commission filed a petition on Wednesday which will be heard next week. The poll agency has come under intense political pressure from the right with one conservative senator threatening to sue the body for not taking action on the issue of Mr Pita’s shares in a defunct media firm at an earlier stage. On Wednesday, a last-minute petition was filed with the court which ruled that it was too late to consider at its weekly meeting on the same day. This will now be reviewed next Wednesday adding another layer of uncertainty to the political situation as it is certain how the court may rule or the extent of such a ruling even if it goes against Mr Pita. According to a Thai PBS World report, the EC made its decision this morning and submitted the case for the Constitutional Court’s consideration. The Constitutional Court will be meeting at 1pm today to consider if Pita will be suspended in the meantime as they consider his case. In doing so, the EC also requested that the Move Forward leader, whose party won the most votes in the May 14 general election, be prevented from working as an MP until the court decides if it will accept the case. The court is expected to make a decision in the next 3 days. It is only now that the yellow shirts wake up to witness the cleverly crafted judiciary coup on one of their own. Now they agonized over the unfair treatment of Pita.
