Typical - DOJ will appeal the politicized Trump document case.

Featured Replies

Ahhh the DOJ don't mind politicising things so long as they are doing the politicising.

Of course the DOJ will appeal this - Special Counsels have been a standard part of the US legal system for decades and as the Supreme Court stated in relation to the Nixon tapes subpoena, their appointment is wholly consistent with the US Constitution.

United States v. Nixon, 418 U.S. 683 (1974)

Furthermore, as stated in the article referenced in the OP:

Cannon's ruling "deviates from the uniform conclusion of all previous courts" that have considered the issue. Courts have consistently found the attorney general has the authority to appoint special counsels to handle certain investigations.

It's gonna be interesting.  It's not unusual for a common practice that's been going on for years to be found unconstitutional when a party brings it up.

I'd also remind you that it was "common practice" for presidents to take arguably classified documents when they left office, even since the Presidential Records Act.  Up until Trump, none of them were prosecuted for it.  At worst, they argued, lost the argument, and gave up the papers.  I can't name one whose home was raided at gunpoint.

So much for the concept of "common practice" when Trump is involved.

Edit:  Read this if you want to understand why they're so eager to have her pulled from the case:

The second version Cannon asked for assumes that as president, Trump had complete authority to take records he wanted from the White House, which would make it nearly impossible for prosecutors to secure a conviction. If she were to institute this sort of instruction, Smith’s team said, “the Government must be provided with an opportunity to seek prompt appellate review.”

They can appeal all they want.  It’s an exercise in futility.  By the time the case is put to rest, Trump will be the President.

Appeal is just more Democrat, libtard lies, deceit and lawfare.

Trump will keep winning because none of this ultimately stands even a sniff test.

Heard about new evil genius J6 move by Chuck Schumer (D - Tel Aviv) all J6 Trump duties will be codified into law as "unofficial" business thus reopening j6 lawfare.

Last gasp from death star.

I say this in all seriousness. If you honestly believe that you need psychiatric help.
