So far, the DoJ hasn't charged any of the Proud Boys or Oath Keepers of any of the other January 6th rioters with insurrection under Section 2383 of Title 18. Instead, several of the participants have been charged and convicted under Section 2384 of Title 18 for seditious conspiracy. 

 

Seditious conspiracy carries a prison sentence of up to 20 years, while insurrection only carries a term of up to ten years plus disqualification from holding Federal office. 

 

The events of January 6th 2021 were a seditious conspiracy on the part of at least some of the participants as has been proven by the courts and this is a more serious offense than insurrection as evidenced by the longer potential prison sentence.

Just indicted so far. The experts are saying he is toast though, particularly with a DC jury. The espionage case also has him red-handed. Haven't heard from Georgia yet, or Arizona or Michigan. Regardless, he will be spending the next few years in court and/or in prison.
