I found a Unofficial translation of the Vehicle Act on the Internet:
Section 56. Subject to the provisions of section 43 and section 57, no
owner of vehicle or driver shall allow any person who has no driving license, or
having a driving license of other category of vehicle which is not interchangeable, to
drive his or her vehicle or the vehicle which he or she is the driver

Section 56. Subject to the provisions of section 43 and section 57, no
owner of vehicle or driver shall allow any person who has no driving license, or
having a driving license of other category of vehicle which is not interchangeable, to
drive his or her vehicle or the vehicle which he or she is the driver

Thank you

This is where it pays to have a samlor rather than a tuk tuk. A samlor is classed as an illegally modified vehicle, so there's no question of having a valid licence to drive it. lol

Was the TukTuk insured ?

It was the 4 wheeled variety ? - what is different from this than another small van ?

If the foreigner had a driving licence (in English Language or an IDP) then I can't see how he was driving illegally ?

Are these 'TukTuk's a special license ?

------

We used to drive TukTuks in Bangkok for a laugh - we'd pay the driver a little extra to let us have a go....    Our driving licenses covered us for 3 wheeled vehicles so there was no doubt of legality.

However, there may have been doubt over insurance - but realistically, I doubt any of these TukTuks are insured beyond the basis Por-Ror-Bor anyway, which means anyone can driver them.... no ?

This is is more to do with...

....  "Being a foreigner and colouring outside the lines"....   Thai authorities tend not to like this...

I cant see that there is anything illegal about it at all...

Of course he does, everyone driving a vehicle on the road needs a valid licence.   How could you even pose that question rationally?

The tourist has suffered no penalty, no ticket, no fine, no deportation, so why are you going on about deporting all tourists as though the one in this incident has been treated unfairly?

Even you cannot be this literal and obtuse....

Its pretty clear he meant 'specifically a TukTuk license'...      as if such a thing even exists.

Thus: the what could the possible charges be against a foreigner driving a TukTuk ?

Its no different that you driving my car (if you have a license).

OR... does the Por-ror-bor (basic insurance for) TukTuks  ONLY allow for Thai Nationals to drive it, which I doubt.

True....  But what exactly has the TukTuk owner done wrong ?

Is this any different from you letting your mate drive your car ?

Be nice to see what Section 56 actually says.

What a load of steamy ****!

Just some simple fun with no harm done and the tourist was a taxi driver.  I'd do a few turns on a tuktuk if given the opportunity.

The Thais are going to regulate & fine themselves out of a tropical vacation destination.

In this case they're regulating everyone but fining a Thai, not a tourist.

As long as you have a licence that would be no issue.

I helped a old Thai man ride his try cycle back to my hotel after hiring him to take me to a nightclub, I bought him a few drinks and he was to tired to get me home so I rode the bike and he was passenger was a good bit of fun

Some time ago, after a nine hour flight, i caught a taxi from the airport to Morchit. On the way the driver asked where i was headed and when told, he offered to drive me 360k to my home. About 50k out he stopped to buy some tonic to keep awake. The 3rd time he did this, after nearly falling asleep, I offered to drive which he accepted. So I drove his taxi 300k home!

Did he have a public vehicle driving licence that taxi drivers need in Thailand?

Yes, it is different...to drive a taxi a public service vehicle licence is required.  The tuk tuk owner permitted an unlicenced driver to drive his taxi.

The tuk tuk owner was getting a few extra quid.  For keeping the forigners happy snappy for social media

And another tuk tuk owner must have gotten red eyes.

No insurance company will pay up if tourists get an accident with a tuktuk.

Same reason I don't let my children drive my car. Not rocket science this fine, is it?

Is it ??   I'm not sure but you seem to answer with certainty so you may know the facts, or at least state the information as a fact.

When taxi driver takes his family on holiday using his taxi - he's not using it as a public service vehicle, he's using it as a private vehicle. If he were to let a family member drive that car (taxi) while on holiday, is that then illegal ???

i.e. Can a Taxi, or TukTuk or Motosai taxi (with yellow plates) only EVER be driven by those with specific Taxi or motorcycle taxi licenses ???...   even when used privately....

As per my point above, drivers of registered taxis need public service licences.

Best that you check all your questions with the Motor Vehicle Act...I'm sure that you can get the answers to your own questions yourself.

So you are not sure ?

I asked you because you seem very knowledgable about this.

IF you are stating your comment are factual and not just an assumption, I'll take your word for it... you are not known for BS'ing on this forum.

Wouldn't one think that the Taxi driver had a License from his home country ?

I think what LL is stating is that a taxi is a public / commercial vehicle, as such, anyone driving it (no matter the nationality) requires a specific commercial license for taxi's.

This makes sense.....   but also makes me question why the TukTuk owner was charged and not the Tourist who was also driving the taxi illegally.

No... its still a TukTuk.....

.... TukTuk is just the name for that type of small transport...

They can be 3 or 4 wheeled and vary throughout Thailand.
