OP - did you not have to obtain an affirmation of freedom to marry document signed and stamped by the Australian Embassy prior to your marriage in 2001? If so, it might be worth your while checking whether they still have this document - although I accept that this could well prove a long shot after so long.

Unlikely as he's married.  Of course, could always get a divorce first, there's an idea.

If he never registered his marriage in Australia, how would they know?

Well the embassy would have already issued that years ago. But in any event getting a new document proving you're not married is not going to help much with getting a marriage extension.

It's the actual document he is missing, not sure if the Thai IO would care about the date on it, just that he isn't married already in Australia. Either way, it's just a thought about how to appease Thai Immigration.

We will go back the the Ratchaburi office where we originally registered out marriage. We will see what document they provide re: the "single status". It seems a silly requirement, as you cant get a marriage registration if you cant show you were previously unmarried. Going back to the original office was suggested to my HR officer when she later spoke to immigration (she turned up late so she was not there when my wife and I spoke to the officer).

The "single status" documents are apparently only kept for 10 years before they are destroyed. I really don't remember what documents I may have obtained from the Australia embassy at that time. So we will go back to the registration office in Ratchaburi to see what they can do. At the very least, they should provide a document to state that the record no longer exists (once we have all the documents ready, we will approach immigration to check its adequate. The wheels may need a bit of greasing for any missing paperwork, but my wife is fine with that...thai style. lol

Embassy response yesterday:

Apologies for the incorrect information below.  We misread and thought that you would like to request a document to prove that you are currently single, but we can see now that you have been married since 2001 and therefore the CNI information provided below unfortunately does not apply to your situation.

The Embassy is unable to issue any other document to prove that you were single in the past.  You may wish to convey this message to Thai Immigration again that you have already contacted the Embassy and we had no document or service that is applicable to you in this case.
