My mates and I were making this the conversation at afternoon tea, and jeez, Im not going to criticize this lawyer for taking his time, the number of legal issues is boggling.

 

Starting off with jurisdictional issues. Otherwise its a simple case, did x wrongfully kill y. But before you even get to that point....

The terrorism label by the WH is just a guise to attempt to get legal under 'war time' rules with the killings in self defense narrative. Fact is the Americans brought this on themselves, its the Americans who are killing themselves dating back to the slack laws on opioid drug use in the 90's leading to a dependency to self harm today. They created the monster and they are now left killing foreigners running a business overseas. This isn't addressing the route cause at home, just typical knee jerk reactive politics the current admin is renown for.

As for "had complete authority to do" does not constitute legality. Again, the video will show who might have given authority for a second strike, and such an order had better not note "survivors", because survivors and second strike violate the Pentagon's own Law of War Manual.

:cheesy: "law of war manual" which presumably approves carpet bombing and  the use of nuclear weapons  and here you are crying about a few dead drug smugglers,

          Maybe I am wrong and the "war manual" has been updated to include not using "hurty words"     and advice to avoid any chance of misgendering people or generally  causing offence

Correct on both points, well done :clap2:   I have never served and I never will, I have no idea about the contents of law of war book, and I can't say I am particularly interested.  

As far as I am concerned the drug smugglers being turned into fish food and sent to the bottom of the ocean was a much better result than taking them into custody were they would either languish for years at extortionate cost to the taxpayer, or even worse, be released and pardoned , probably with an apology and some compensation, following the endeavours of some leftist "human rights" lawyer

         I cannot understand anybody whinging about this , if it was not for a few idiots obsessive hatred of Trump this incident  would never have been reported in such a negative way it would have been celebrated, and quite rightly too.   Its time for the self flagellation to stop, its not a good look,

I think the issue goes beyond the Form. I guess it would be phrased as "can a court exersize subject matter jurisdiction over a tort claim against the US in a situation where...."

That's OK, some of us have difficulty grasping concepts and learning new ideas outside our own insulated spheres. Simply put it takes two to tango. You got the sellers and the buyers in the illegal drugs trade. Killing only one of them in extremely questionable circumstances ain't going to fix the other. Its just adding illegal killers into the equation innit.

Hegseth also said he “didn’t stick around” for the remainder of the Sept. 2 mission following the initial strike and the admiral in charge “made the right call” in ordering the second hit, which he “had complete authority to do.”

It's not the fog of war, it's the fog of Little Pete, his tiny brain, his unprecedented lack of experience, and his gross incompetence.

Well ignoring all laws of international order is not a good look either, it makes the US look rather lawless and more and more like a Banana Republic, completely outside any behavioral norms. The life of Petie and Don.
