The 2 main questions in the birthright case:

Constitutional Interpretation: Does the 14th Amendment’s Citizenship Clause apply to children born in the US to parents who are not "subject to the jurisdiction thereof" (i.e., unlawfully present or temporary visitors)?

Executive Authority: Can a president unilaterally change the definition of birthright citizenship via executive order, or does this violate established Supreme Court precedent?

NB the second may end up being more determinant than the first

Cannon, who Trump appointed to the bench in 2020, dismissed all the charges in 2024.

Trump was accused in the case pursued by Special Counsel Jack Smith of illegally storing documents related to U.S. national defense, including the American nuclear program, at his Mar-a-Lago social club and obstructing U.S. government efforts to retrieve the material. Cannon found that Smith had not been lawfully appointed by the Justice Department during Democratic former President Joe Biden's administration.

Disclosure of Smith's report "would contravene basic notions of fairness and justice in the process, where no adjudication of guilt has been reached following initiation of criminal charges," Cannon wrote in Monday's ruling.

Judge Cannon's above ruling is now under appeal at the 11th circuit -- the same appeals court that overruled her on the 'special master' issue in the docs case.

However, two legal groups who favor release of the report — American Oversight and the Knight First Amendment Institute — sought to formally intervene in the dismissed criminal case to argue in support of disclosure. Cannon denied them permission to do so. The groups’ appeal of that decision remains pending at the 11th Circuit Court of Appeals.

“Judge Cannon’s decision to permanently block the release of this extraordinarily significant report is impossible to square with the First Amendment and the common law,” said Scott Wilkens, senior counsel at the Knight Institute. “There is no legitimate basis for its continued suppression.”

Read well your source. Dismissed the case for the reason you mention, not dismiss "all the charges" on their merit.

Interestingly a 10% drop in viewership from last year and a 10% rise from last year on if it's thought Trump is directing the US in the right direction.
