Hello,

I would like to register a non-profit organisation. My questions are as follows :

  • Are there legal vehicles for this other than foundations?
  • If so, what is the most efficient solution in terms of registration?
  • Can foreigners be trustees / committee members?
  • What are the requirements?

Another option to a Foundation is an Association. It is similar process to the setting up of a Foundation but the objectives and purpose would be different. Foreigners can be directors and committee members but you would still need at least one Thai to be a committee member.

Let me tell you a bit more about what a Foundation must and must not be. The Foundation's Objective must not be illegal, against the good morality of the public, or be harmful to the peace or national security.

• Objective shall not be set up for soliciting money from people or raising funds for spending in operating of the foundation.
• Objective shall not be set up for lending out the fund, or mortgaging, or pledging for any revenue or profit.
• All foundations have to have these two following objectives to add with the main objectives of the foundation:
1. “The foundation is established to cooperate with other charity organizations in operating any activities of public interest” and,
2. “The foundation shall not involve with any political activities”.
The initial registered fund of the foundation must be in cash not less than 500,000 baht, or not less than 250,000 baht if there are other assets included with the initial registered fund. However, foundations that are established with the objective to operate social works, or support education, sports, religion, public hazards, or operate medical treatment, research, and drug prevention or AIDS must have the initial registered fund in cash not less than 200,000 baht.
The process to set up a foundation can take 3 -4 months.
