Pheu Thai threatens 'eye for an eye' as Democrats head to court

BANGKOK: -- The opposition Democrat Party will next week file a slew of charges against House Speaker Somsak Kiatsuranont, deputy Speaker Nikom Wairatpanij, secretary-general Suwichag Nakwatcharachai and 308 parliamentarians for pushing through an amendment to the Constitution that has since been ruled unconstitutional and unlawful.

Democrat MPs will also seek the impeachment of Prime Minister Yingluck Shinawatra, along with Somsak, Nikom, Suwichag and the 308 lawmakers who voted the blanket-amnesty through on its third reading.

The decisions were announced by Democrat leader Abhisit Vejjajiva after he chaired a special meeting of opposition MPs.

The meeting came after the ruling Pheu Thai Party lashed out against the Constitutional Court's decision that the charter amendment bill for a fully elected Senate was unconstitutional.

After being on the defensive for the past week, the Pheu Thai Party is countering Democrat Party moves with legal action on an "eye for an eye" basis, a high-ranking Pheu Thai source said.

Abhisit said his party condemned Pheu Thai's defiance of the court's authority, as it undermined the rule of law.

He called for Yingluck and her party to rethink their attack on the Constitutional Court and take responsibility for their actions.

"Prime Minister Yingluck, who has submitted the proposed amendment to His Majesty for endorsement, should report the court's ruling to the King," Abhisit said.

The prime minister yesterday responded to the court's rejection of the Senate-change bill, saying she needed time to study the verdict before charting her next move.

"What happened was unprecedented, hence I have asked the Council of State and the legal team to study [the implications]," Yingluck said.

She defended her decision to submit the change for royal approval, saying she was constitutionally bound to do so by the deadline.

In response, the opposition called for Yingluck to take responsibility for the hasty royal submission and resign.

The prime minister voiced optimism that the legal wrangle over amending the charter would eventually be resolved. However, she refused to comment on Pheu Thai plans to impeach Constitutional Court judges for striking down the charter amendment.

"I just want all sides to heed the opinions of one another and carefully consider the various options," she said.

Regarding the National Anti-Corruption Commission inquiry on accountability based on the verdict, she said she hoped the justice dispensed would allow everyone to carry on with his or her work.

Commenting on litigation looming over the Bt2-trillion mega-project loan bill, she said she had yet to receive the relevant legislation from Parliament.

Sangiam claimed the judges had violated Article 112 of the Criminal Code in conducting their judicial review of the Senate-change bill during the process to seek royal approval.

In answer to your points:

She won't know the detail, the progress, the legitimacy of any of the bills progressing through the system. Minions take care of all this. It's clear she's not particularly interested and whoever is in her briefing team don't seem much better. Scary when you think she is supposedly running the country and its defense.

PTP always support any court ruling that favors them, and ignore any that doesn't, They use the law as a tool for threat and intimidation when it suits, but act illegally themselves without remorse or apparently consequence. They really don't know right from wrong, only what's good for them.

Tarit is simply Thaksin's lackey and demonstrates over and over again his willingness to do what he's told without question. He will bend the law and apply some very creative interpretations and comes very very close to defaming opposition members with his personal attacks. On the other hand he nonchalantly dismisses any charges against the regime clan and cronies without real explanation. He's part of the Department of Justice - cheesy.gifcheesy.gif His boss is the AG. Remember, PTP wanted to change the law so people had to submit complaints against the government to the AG's Office first rather than direct to the Constitutional Court. Wonder why?

Now this latest threat of an eye for an eye - really shows how they respect the law and desire reconciliation.

your wasting your breath thats exactly why people here become politicians. And that applies from local level to top. Locally if you can get elected head of village or buy it you get control of village fund and hand out favours and loans from it to your "friends" as well as tons of other scams. While their might be a village head who does not do this their also might be people who finding a 1000 baht note hand it in to police. They exist but hardly any. Then next step it to be elected (actually always bought) as part of next level of government along with your team which means you get to share out any crumbs handed down by next level up for public works and also can decide who does them. And so on up the scale it goes. Before Taksin and his vile bunch had control this was limited to a reasonable 10% or so take and could be considered as compensation. In my view the system worked quite well and was far less corrupt than west were the corruption is rampant but well hidden in so many ways. Trouble these days is due to Taksin and his gang everyone has got totally over the top greedy and no longer content with smallish tea money but are now demanding more and more. Everyone who has had any business dealings here knows you don't need to pay but if you do things work far better. I always consider it payment for express service. Land offices and other government departments are often given extra for express service but its minor and given really low pay of officials I see no problem. If someone wants to give a tip to a official to avoid you having to wait around all day and other who done simply are put at back of Q then I see no problem with that. Same with the police. Ive never seen anything very wrong in over 30 years in Asia with any of that even though it goes against hypocritical high ground of most western people here.

As I said before Taksin everything worked fine and those who had power got a reasonable cut which is opposite of ridiculous expenses, salaries, index linked pensions and all rest out so white uncorrupt scum bags get in the west. And thats not even mentioning top politicians who later get vast payments for consultancy and the rest. I much prefer the open system of tea money prevalent in Asia and particularly here in Thailand. Thailand had it right compared with other Asian countries which in my business experience were far far more corrupt than here.

So problem is not Taksin was corrupt and took the problem was he was and is just so greedy and obsessed with total control he broke all unwritten rules that made it work.

That's a very good assessment of reality. I agree - on your comments on Thailand, Asia and the West. My experiences over the last 25 years would suggest similar.

You only have to look at the EU if you want to see real corruption. It's noticeable that despite all the laws, procedures and checks designed to ensure transparency, the EU, UK and US have all recently strengthen their anti-corruption laws.

Thailand certainly had it right compared to most Western countries too, but then the greedy all powerful one came along.

It's actually typical of Peua Thai's usual strategy, by putting in a bunch of spurious complaints to the courts the two party's fate's become paired, thus when Peua Thai get cut down on realistic charges and the Democrats get let off on petty charges, it still likes like the courts are biased in the eyes of the masses.

So the chances of any real work being done in Parliament are equal to 'diddlysquat squared', where diddlysquat is the new mathematical constant derived from the percentage level of interest and loyalty Thai MP's have for the electorate or Thailand as a whole, which is ......zero.

Forget your kids being a Doctor to make money in Thailand, they need to be constitutional/political lawyers. The only ones completing their business mission statements in this country at the moment are the Bangkok Law firms who are engaged by the politicians. Talk about raking it in....keeeerching !

These are sad and worrying days. It is truly a tragedy that the Thai people are being robbed of the future that they voted for so convincingly. Are democrat politicians unable to comprehend the orderly process of being professional parliamentarians in opposition within Parliament?

A professional politician should not attempt to cheat by:

sneakily changing documents

Voting multiple times

Lying about voting times

That is the sad thing - however democratically elected cheats will never be accepted by any nation
