‘Evil man of Krabi’ eligible for bail during appeal process

KRABI: A tour guide was sentenced to 20 years in jail last week for the rape and assault of a Dutch tourist in Krabi last year.

However, Chumpol Khanonuang, 27, can appeal the case in the Appeals Court, said Krabi Provincial Police Commander Nantadech Yoinuan.

“Chumpol’s bail has been set at 700,000 baht,” he added.

It was bail that earned Mr Chumpol the moniker “Evil Man of Krabi” after the father of the 19-year-old victim, furious that Mr Chumpol had been freed on bail, made a music video mocking the justice system in Krabi and uploaded it to YouTube (story here).

Mr Chumpol told police that he had consensual sex with the victim, who had deep bruising to the right side of her face and a split lip when she registered her complaint with the police.

When contacted for a statement, an officer at the Krabi Provincial Court responded that the court “could not reveal the sentence or give a copy to people who are not involved in the case.”

“This high season and upcoming new year, we expect to receive a lot of visitors in Krabi,” the officer continued. “Police have launched a new safety campaign to ensure tourists have a safe and enjoyable time here [story here].”

Gen Nantadech added his own cautionary word to visitors, “Take care when drinking alcohol, as situations can become more dangerous due to the effects of alcohol.”

Gen Nantadech was reiterating the words of Krabi City Police Chief Thaksin Phochakorn, who said the same thing to the Gazette last year.

Col Thaksin also admitted last year that the recurring issue of rape and sexual assault was taking its toll on his officers.

“We are heavy-hearted over this issue because it is consistently recurring in Krabi and, according to Krabi Police records, in many cases the victim is a tourist.

“Almost 100 per cent of sexual assault victims in Krabi knew their attacker beforehand. The encounter usually begins with the victims being friendly [with the attackers] and being willing to drink and hang out with men they do not know well,” he said.

Just checked and see the video made by the father has been removed from YouTube.

Have anyone outside Thailand checked if it is there. I have seen a few times it is removed here but not elsewhere.

I am amazed that a convicted rapist could be freed on ANY amount of bail simply because they appeal the conviction. That's insane!

Everyone gets bail in Thailand, even murderers. Money rules.

so as long if they only target visitors

and as long as the attacker offer drinks

and as long as alcohol is involved

it is all ok for thai police to even release this scum of a certain rape charge

outside of Thailand it is gone too. But this is there...........

Base on this clip, the police talked such non sense, he kept saying B/S of how importance about this type of crime but he did not get to the point at all. What a waste of time listening to him. He is another A-hole Thai police who is not competent.

Imagine that if his daughter (if he has any) was raped, the rapist would not be set free on bail.

I thought that once convicted, the appeal process takes place whilst you are still in jail. Only in Thailand can a convicted criminal be released when there is an appeal. Justice does not exist in Thailand, not in the real sense anyway

....so does that mean he will continue to be in contact with foreigners....working the 'high season'.....

....'God Forbid' that we eat into his earnings just because he is a murderer (?) and violent rapist...after all his victims are only foreigners......

That statement is ridiculous and couldn't be farther from the truth! Most rape victims do NOT know their attacker beforehand. After all those pigs don't really aim at getting caught, now do they?!

Sigh... Why do people constantly claim that Thailand is unique in these matters? It is not. Here for example, is a Canadian case where the defendant was granted bail after being convicted of second degree murder: http://en.wikipedia.org/wiki/Robert_Baltovich. Wow, a convicted Murderer and Rapist allowed bail,

I'm sure all tourists going to Krabi will feel perfectly at ease knowing a Murderer and Rapist might be out roaming the streets,

Well done to the Thai Justice System.

The question is rather one of normal treatment of the accused. Whether charged with common assault, or illegal sexual intercourse ( not rape ) Bail is almost always offered in the west as well as in Asia, The difference is that we perceive any crime against a Non-Thai as morally offensive where we also tend to view crime against a Thai as non-serious. Some Thai police tend to corruption but the bulk of them are trustworthy and honest and this logic also applies to every Western country as well. It would be interesting to see the evidence to determine the degree of guilt but that is a court's job and a Music Video played by the overseas and perhaps misinformed parents of the injured girl can hardly be taken to be evidence since it shows a slight bias. Consider what you would expect to see in your own country and look at the evidence before casting aspersions. Thai Justice has been called unnecessarily harsh but it is usually fair.

I was just wondering what happens to the bail money the courts charge?

Are they all given to the ministry of justice or part to the ministry and part lining their pockets?

Either they are called BIB or government officials.

Does anybody know the truth?

This is not so shocking. Even during the short time I have spent in Thailand, I have seen bail set and then the news seems to just "go away". Out of court settlements? Bribes? A call from somebody on top to make it go away? Who knows?

Sadly 'saving face' is far more important than any kind of justice in this land of sad events, the police don't give a rats ass about justice as long as there is a good veneer on their area, they are making tea money and have whisky to drink. Truly DISGRACEFUL !!!

This guy hasn't been charged.....he's been CONVICTED. Some difference I think.

Yes, I was just thinking that the "cautionary" note from the kindly BIB officer, shouldn't have been about drinking, it should have been that there are convicted rapists and murderers roaming the streets of Krabi. This guy isn't the only one I believe.

Although to be fair, it's not clear if he has paid the bail money yet. So he might still be locked up.

Actually, it is a well established fact that the majority of rapes is by a person known to the victim. Known in a lose sense, it is often they meet in a bar or such and don't know each other prior to that. The so called date rape.

That is true in the West and probably also in Thailand.

Sounds like the "old" safety campaign was not too successful then. Any guesses why?

It is common procedure to allow bail on appeal depending on the seriousness of the crime. The three alleged murderers in the Krabi Bobby Carter case also got bail although they have not officially been convicted. The bail money does go into the court escrow account and can only be refunded on presentation of the receipt in the bail posters name.

Meanwhile, my wife's daughter remains in jail for 8 more years. She finished two years. By the way, no possibilities of bail for drug addiction. She did receive a phone call prior to sentencing asking for one million baht..to make it go away. So sad, she did not have it.
