BANGKOK: -- The National Anti-Corruption Commission (NACC) Tuesday decided to drop the case against caretaker Prime Minister Yingluck Shinawatra and 72 others related to the charter amendments of the Senate's composition.

Yingluck and the 72 senators and former MPs were among 381 senators and former MPs whom were filed complaints against for having supported the unconstitutional charter amendment bill.

The NACC said Yingluck and 64 senators and former MPs voted for the bill only in the third reading and eight others did not vote for the bill in the third reading so the NACC decided not to pursue the probe against them.

But the NACC resolved to conduct an investigation against 308 exMPs and senators for having supported the unconstitutional charter amendment bill on Senate's composition.

The NACC decided to investigate 293 exMPs and senators who voted for the bill in the first and second readings. It also decided to probe 15 exMPs and senators who sponsored the bill.

The Constitutional Court has ruled that the bill was unconstitutional. Following the ruling, complaints were filed against 381 exMPs and senators for their role in passing the bill.

Why?

YL is the Prime Minister.

The fact that she is not interested in politics can not be true blame society.

She has a responsibility taken over as the national leader to govern the country.

She is the Indian chief. And if their Indian warriors lead their tribe war, she is responsible for it!
Ignorance should not protect from punishment.
Especially in the highest office of the land!

it seems easy to believe she had little or no actual hand in what goes on there.

They have made a point of shielding her from actual business functions.

Technically she is the head of them all, but in Thailand they fall on their swords for the liege lords.

Then she still has to survive tomorrow:

8 January the constitution court will rule whether section 190 of the charter amendment violates section 68 of the charter,

After the previous refusal to accept the constitution court and the threats and intimidation against the judges they will not be PT's best friend.

This could throw yet another spanner in the works as far as Feb 2 is concerned. The water gets more and more murky by the minute.

For the sake of the good people in Thailand (let's face it, that's the greater part....I hesitate to use the word 'majority' ) I wish a sensible path could be found through this almost impenetrable maze.

That will be an interesting judgement especially as abhisit and the dems were going to amend the very same Section but the PAD were non too happy being ultra nationalist and all that.

Here's what should be some embarassing reading for abhist fan boyz about Constitutional amendments and referendums and all that stuff that the dems condemned the PTP for doing (or not doing) even though they acted in exactly the same way themselves

PAD can target Abhisit as the Democrats are now full-blown supporters of the proposed constitutional amendments, but it is interesting that the PAD are focusing on the more narrow aspect that referendum on the amendments is needed first. Technically, under the constitution, a referendum is not needed, but given the 2007 Constitution passed by referendum PAD are making the political argument that a referendum is necessary this time around........ Another problem for the Democrats and Abhisit, in particular, is that they have stated in the past that a referendum was required if the constitution was to be amended..................... BP: So why is no referendum needed now? The reason for the change is clear. Looks like the coup train is on schedule. For those that want to have some Tuesday fun, I reccomend reading the Thai constitution and then contrasting the actual text to the judgements of the constitutional court. Start with the amendment procedures set forth in section 282.

As for these "corruption" charges they merely formalize what many of us have been suspecting, I.e. that when people talk about their disdain for "Corruption" what they actually mean by "Corruption" is "Democracy".

Passing a bill that is later deemed unconstitutional is somehow illegal? This seems to go a bit far. How many laws have passed through the US Congress, been signed by a president, then been declared unconstitutional by the supreme court? Should all these congresspersons and presidents be charged?

The converse is also true. When PTP talk of their love for "Democracy" what they actually love is the "Corruption" this faux democracy entitles them to. And with 90% of their supporters unable to grasp the concept of democracy beyond "one man one vote" is it any wonder that they wallow in corruption like pigs in muck.

BANGKOK: -- Caretaker Prime Minister Yingluck Shinawatra was cleared yesterday by a national anti-graft body probe into her role in charter-amendment legislation that was ruled unconstitutional.

The National Anti-Corruption Commission (NACC) voted 7:2 to drop the case against Yingluck and 72 senators and former MPs in connection to proposed charter amendments relating to the Senate's composition.

"The NACC found that their roles were insufficient to implicate them, and also that their actions are protected under Article 130 [of the charter, which stipulates lawmakers' basic rights in casting votes]. The allegation against them on this matter has no grounds and has been rejected," NACC member Wicha Mahakun said.

Yingluck and the other 72 were among 381 senators and former MPs against whom complaints were filed for having supported the unconstitutional bill.

The NACC said Yingluck and 64 senators and former MPs voted for the bill in its third reading only, while eight others did not vote for the bill in the third reading. They did not take part in proposing the bill.

However, the NACC decided to press charges against the remaining 308 senators and former MPs, NACC member Prasart Pongsivapai said. Among them, 293 senators and former MPs proposed the bill and voted for it in all three readings, while 15 others proposed and voted for the bill in some readings.

Prasart said these 308 were responsible for proposing the charter amendment at the outset, and took part in scrutinising. Their roles and participation are regarded as sufficient for indictment, and could not be defended under Article 130 of the Constitution.

Earlier, the anti-graft body found grounds to pursue charges against former Parliament President Somsak Kiatsuranont and his deputy Nikom Wiratpanij for violating the Constitution over their roles in passing the amendment bill. The NACC said there was sufficient evidence that the two accused could be deemed to have performed their duties dishonestly, abused their authority and violated the ethical code.

Meanwhile, some red-shirt leaders might be disqualified from running as party-list parliamentary candidates next month after the Election Commission yesterday declined to endorse them.

EC secretary general Puchong Nutrawong said the commissioners refused to endorse 87 party-list MP applicants from 25 political parties, including four from Pheu Thai.

They are red-shirt leaders Arisman Pongruangrong and Jaran Ditapichai, former MP Thaworn Triratnarong and Pol Colonel Viroon Phuensaen.

The EC cited unmet requirements including voting in the previous election or belonging to the nominating political party as a member for at least 30 days.

The EC told the group to appeal to the Supreme Court within seven days and it would take the court's opinion into consideration in making a final decision, Puchong said.

The unqualified candidates and the party leaders who endorsed them would have to be investigated and any punishment would be considered case by case, he said.

The politicians are not constitutional law experts. They pass a law the Thai Court makes a ruling, THE END.

The charter amendment should have never been reviewed by the court and should not have been ruled unconsitutional. That would make the 1997 constitutional unconstitutional in which the senate was compleyely elected.
