Niwattumrong says martial law cannot overrule charter

BANGKOK: -- Acting Prime Minister Niwattumrong Boonsongpaisan said Thursday that the martial law that has been declared by the Army cannot overrule the Constitution.


Niwattumrong said he could not resign to pave way for an interim government to be formed as the Constitution requires the caretaker government to continue administering the country until the next government is formed.

He said the Constitution is the highest law of the country and the martial law cannot be invoked to suspend enforcement of certain articles of the charter.

As a coup has now been called Niwattumrong has clearly been outpaced by events ( again ). So that's pretty well it. Niwattumrong is no longer PM ( though it will doubtless occupy historians for years if he ever was. In any event, it came down to 15 days ). And what was left of the cabinet is similarly retired. Prayuth made a sincere effort to see if any consensus could be forged between the parties. According to the UDD's Dr. Weng, there wasn't any agreement between them and the PDRC at all. And then of course Thaksin had to stick his foot into it earlier today by immediately putting his foot down on all three of Prayuth's proposals. That was probably all that was required of a back to the future moment. So here we are. In all likelihood the Senate will proceed, and a neutral interim administration will ensue. There hasn't been an administration with the power of the purse since December 9, so a lot of catching up to do. Reform talks can now take place, and that is a very good thing indeed. It will also be most interesting once the fiscal books have been inspected, not to mention the rice silos, and every other mess that Pheu Thai has left in its wake.
