How can one apply for a visa in order to get married in the US?

 

Both are expat residents in Thailand and 1 is an US citizen. Gay marriage in Thailand is illegal so they want to get married in the US.

A tourist visa will not be possible for the non US citizen partner. 

 

Does anyone know a solution?

Based on this, same sex couples now have the same rights for marriage (or fiancee) based immigration.

To the OP, based on this information I posted, why don't they just contact the U.S. embassy and see what's involved to begin the process? 

 

I am a little curious why marriage would be a priority if the couple intends to live in Thailand, as after all, their U.S. married status would not be recognized in Thailand.

As with opposite sex tourist visas sponsored by an AmCit, the burden of proof is on the visa applicant to establish to the interviewing consular officer that s/he will return to Thailand after the U.S. visit.

Friend of mine (Thai male) went to California on a legit student visa. Fell in love with a US male there and got married after more than a year, no problem.

 

You don't need any special visa to get married in the US. I would think even a tourist visa would do.

He says he can't get a tourist visa. Its true not everyone can for the US.

I think your best bet is to contact a lawyer in Arkansas and get married there at City Hall. They are very tolerant there of Homosexuals getting married and suchlike.

By this time next year, there is decent chance it will be legal in all 50 states, even your joke states. Actually there were already legal gay marriages done in Arkansas and they are still valid federally, but no longer being done there now. This isn't really relevant to the OP. If they can get the visa needed there is no problem finding a U.S. state to get married in and that marriage will be fully legal the same as any marriage at the federal level.

Is the couple planning on staying in the U.S.?  If so, K-1 (Fiance Visa) is the best bet.
