Last year I did my first 1 year extension, based on supporting my Thai child.

My permit to stay is until 1st May 2016.

I already put 400K in my bank account since 29th Jan. But now I realise this may mean I will have to apply on the very last day in order to comply with the 3 months money aging requirement. (Someone says 3 months, someone says 2 months, last year he insisted on 3 months. Samui Immigration.)

That is why I am now interested in other options:

If I were to claim 40K+ monthly income would it be sufficient to show my Thai personal bank account deposits? Because I am putting way more than 40K into my account every month. I cannot provide a letter from my embassy confirming my income as it's an endeavour ranging from big hassle to impossible (my country has no embassy in Thailand, they can't see my earnings because it's mostly online, etc.).

I also have a registered Thai company and a work permit. But my salary is around 30K. Will it help anything if I increase it now (with only 2-3 months left) to 40K? If this is OK, then what documentation is required in relation to this monthly income?

If this is relevant: My company does not have a business bank account, so all transactions go through my personal account.

  • If Samui insisted on 3 months you were hard done by! The funds only need to be in the account on the day of application. No seasoned funds needed.
  • You need a certified income. Bank deposits won't qualify. Your Thai income isn't enough.

You should check with Samui again.

2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children):

Each permission shall be granted for no more than one year.

(1) The alien must have been granted a non-immigrant visa (NON-IM).

(2) The alien must have proof of relationship.

(3) In the case of spouse, the relationship must be de jure and de facto: or

(4) In the case of children, adopted children, or spouse's children, said children,

adopted children, or spouse's children must not be married, must live with the alien as part of the family, and must not be over 20 years of age except in case of the person hereof is of illness or disability and cannot live without support of father or mother: or

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year.

In case the father of mother requests to be under maintenance of children, the age of father or mother must be 50 years of age or over.

For other necessary cases, the Commissioner or Deputy Commissioner of Immigration Bureau is granted the authority to make decisions regarding approval on a case-by-case basis.

(6) In the case of marriage to a Thai woman, the alien husband must earn an average annual income of no less than Baht 40,000 per month or must have no less than Baht 400,000 in a bank account in Thailand for the past two months to cover expenses for one year.

If you need more time you could apply for a 60 day extension of stay to visit your child and then apply for the 1 year extension towards the end of the 60 days.

I just increased my salary to 40K. From now till 1st May it should be enough of the new salary to show them? Based on the highlighted text you posted it seems not. But my lawyer said it will be fine. Perhaps someone has first hand experience with this?

If it does happen that I miss the deadline and I have to get a 60 day extension, does that break my "consecutive yearly extensions" as they relate to later getting a permanent residence?

I have similar situation, my extension is due on 11 april, when should I start the process?

Also I have sold my house, the children were registered on the blue book of that residence,

we now rent and the children are under their grandmas blue book in the village as the owner of our rented home wont let us put their names on his blue book,will this be a problem when I apply for extension.

I was also told the 400 000bht does not have to be seasoned for this visa.

There are few offices that want the money to be in the bank for 2 months. Perhaps one rogue office that wants 3 months.

You will need proof of residence for where you are living now. A rental agreement, signed copies of the owners house book and ID card will be needed.

There is not requirement for your children to be in the house book for where your are living.

If using income from Thai employment you have to show tax payment certificates / tax return. I don't think future income would be accepted.

I'm not sure if the 60 day extension would affect the PR. I don't think it would, but unless ubonjoe or another member can give you a definitive answer you'll have to check with the immigration office.

This is what the criterion for PR says. I think as long as you've extended the same entry for a minimum of 3 years you qualify and to achieve that you would have had 3 one-year extensions even with the 60 day extension. Note that a 60 day extension is only available one time per entry.

1) Qualification of the eligible applicant to be considered for residential permit:

1.1 Foreign national applicant must hold a passport that bears a Non-Immigrant Visa and was granted with one-year visa extensions which reveal that up until the date of application submission, the applicant have been staying in the Kingdom for at least 3 consecutive years.

In my opinion, I do not think you need to apply in the very last day - no harm to apply for little earlier than that but I could be wrong.

I am currently preparing to request exactly the same as yours, already put 400K on 2 Dec, my permit to stay will be expired on 14 March 2016.

I shall plan to apply on 17 February (this month) instead of 2 March 2016.

90 day reports I start the wheels in motion 2-3 days before. Year extension at least two weeks before. The date the 90 day report or extension is done does not alter from the original date specified.
