New York prosecutors have invited ex-US president Donald Trump to testify to a grand jury over the Stormy Daniels case, his lawyer has confirmed.

 

The Manhattan district attorney has investigated Mr Trump for five years over alleged hush money payments made on his behalf to the ex-porn star.

 

Inviting him to a grand jury indicates he could face charges, experts say.

Donald Trump Access Hollywood tape can be used in civil rape trial, judge rules

 

The tape of Donald Trump boasting about sexual aggression towards women that detonated late in the 2016 election campaign but did not prevent him from winning the presidency will be permitted at a forthcoming civil trial in New York.

 

A federal judge ruled on Friday that the columnist E Jean Carroll can use the 2005 remarks by Trump, caught on tape in conversation with an Access Hollywood TV show personality, in support of her lawsuit accusing Trump of raping her in a department store dressing room in the 1990s.

 

Carroll sued Trump for defamation after he denied the rape ever happened or that he even knew the former longtime Elle magazine columnist, after she first described in a 2019 book her encounter with Trump in late 1995 or early 1996.

If the Grand Jury indicts him, he will go to jail, so that could happen...

I doubt he will turn up as it isn't mandatory. No judge is present; the proceedings are led by a prosecutor and the defendant has no right to present his case or (in many instances) to be informed of the proceedings at all.

The only other country that still uses the grand jury system is Liberia.

If you don’t like Grand Juries, change the Constitution.

The process allows the defendant to produce exculpatory evidence and to make an argument why he shouldn't be indicted.

Don't be ridiculous, Trump will never go to prison, especially not for a misdemeanor.

I only bring context to the story presented and just to say that the time is running out to file a charge, some charge, ANYTHING against the MAGA leader. The feds saw no crimes worth perusing but the NYAG has spent an inordinate amount of time pushing the Stormy story, (hush money is not a crime)

but a campaign finance misdemeanor, lol. No slammer for Trumpie.

 If Trump's vulnerable to prosecution, what in God's name are they waiting for? (maybe some evidence, lol).

Trump attorney Joe Tacopina said in a statement shared with CNN that the campaign finance laws in this case, which is related to seven-year-old allegations, are “murky” and that the underlying legal theories of a possible case are “untested.”

“This DA and the former DA have been scouring every aspect of President Trump’s personal life and business affairs for years in search of a crime and needs to stop. This is simply not what our justice system is about,” Tacopina said."

If you're referring to a witness's grand jury testimony, they are not "defendants", but only a witness. Only a person charged with a crime is referred to as the "defendant".

 

A GJ witness cannot produce their own self serving evidence unless asked, they have no 6th amendment protection (right to counsel) but have protections afforded by the 5th amendment only.

These will be felony charges with the possibility of four years in prison but prison not required. But if convicted some prison is likely. These are not bail eligible offenses.
