Please help with overstay?

Hello,

 

i am in Thailand on a 30 day visa but i think i will have an overstay of maybe five or six days

 

it looks like a short overstay is not very serious but i want to know if i can come back to chiang mai and apply for an extension even with that overstay

 

i guess i would pay the fines, 500 baht each day, but will they also let me get a normal 30 day extension after i pay or will i have to leave the country immediately?

 

im a bit worried so please let me know, and thanks ????????????

if this is your first time overstay i dont think will be any problem

 

but if this is your habbit they will not give you visa anymore.

An almost identical case to yours has been discussed in the attached link.

The OP of that thread did forgot to apply for a 30-day extension of his 30-day Visa Exempt entry, and was on 6 days overstay.  He paid the fine of 3.000,- THB for overstay and was granted his 30-day extension of stay (1.900,- THB).

So normally you should be fine, but do go TODAY to Immigration for your 30-day extension application now that you are still on 6 days overstay (because after the weekend it will be 9 days, and they might not be so lenient then). 

The thread also discusses your options in the unlikely case your Imm Office would not provide you with a 30-day extension due to that overstay.

No one is really sure.

It varies by immigration office and by individual officer on the day sometimes.

Put on your best clothes and be ultra polite. Do it soon.

And if it'll go south, they will give you 7 days to leave the country and return with a visa waiver. Overstay fines will apply of course, 500 per day.

What is the expiry date of your permit.

Why don't you obtain the extension now.

You do not need to do it at CM.

But do go today before Immigration closes. After the weekend you would be on 9 days overstay (and a 4500,- THB fine).  And do bring a copy of the TM-30 notification with you which your Hotel or guesthouse are required to make to notify Immigration that a foreigner is staying at their premises.

I read a tale about somebody recently (since 1 April) arriving in Chiang Mai and getting a 30 day visa exempt entry.  They then are travelling around Thailand for some time and expect to be back in Chiang Mai 35 days or so after arriving and are hoping that this eventual overstay will not prevent them getting an extension.  Or maybe not, who knows.

They can apply for a 30-day extension at ANY provincial Imm Office.  The only thing needed is your passport (with the Tourist Visa or Visa Exempt entry stamp) and a copy of the TM-30 notification that the Hotel/Guesthouse where you are staying is required to make to notify local Immigration that a foreigner is staying at the premises.

I know.  But I was indicating that perhaps if the OP's situation was actually better known it might make answering/advising rather easier.

Isn't the problem that if you get caught/stopped/checked by the police during that overstay period, the ability to pay a fine(500 pd) goes out of the window and you end up with a one-year ban.

I asked for current expiry of 30 day stamp.

No answer.

For all we know he thinks he must to obtain extension in CM as that is where he is renting, however currently out of province.

 

Who knows, all guess work.

If he is currently on overstay he would know rather than state...

Yes if picked up you don't get the option to exit on the spot.

You would be arrested as per the recent publicity stunt by the police nabbing 3 or 4 overstays in .... was it Sukhumvit?

Considering that 45 days were given for visa exempt entries until the end of March, I don't understand how you can currently be on an overstay from a 30 day visa exempt entry.

 

Please double check your dates (arrival and permitted to stay until) in your passport. If you do have a relatively short overstay, chances are that immigration would still be willing to give you an extension after paying the overstay fine.

If you really have a visa on arrival (which allowed a 30-day stay instead of the normal 15 days up until March 31st) than your permission to stay cannot be extended. You must then, immediately, do a border bounce at a border crossing that allows you to apply for a further visa on arrival (all international airports, and a few land crossings).

 

If you have a permission to stay from a visa exempt entry, as noted by others, you will have received 45 days on entry. You should be able to pay the fine and get the regular 30-day extension, only if your overstay is short. If the overstay is more than seven days, they very likely will tell you that you need to immediately leave Thailand. With a longer overstay, contact an agent.

 

To voluntarily overstay in Thailand at the current time is stupid. There are immigration offices in every province, and you can apply for an extension of a visa exempt entry at any of them.

 

Anyway, clarify when you entered Thailand, whether you entered visa exempt or with a visa on arrival, and the current expiry date of your permission to stay.

In this country there's rules and there's rules.

Different offices / different officers means different interpretation and different application of the law.

I see several posters have mentioned taking a copy of the TM 30 form along when applying . Is this really necessary now ? I have done quite a few extensions and never been asked for this .

They will not DEFINATELY give the 7 days refused extension and the OP would return on a visa exempt entry or a visa on arrival.

Going to immigration while you are on overstay is asking for trouble. Needs to pay the fine at the border and leave the country.

The advise is simple don't overstay, yes some people can forget, but Knowing, you can get an extension anywhere, and one is just to lazy, 'coz they read somewhere someone got away with it doesn't make it right, if it becomes a norm then immigration will clamp down on it, making probs for any genuine forgetful <deleted>.  IMO
