PM selection sitting this Thursday now in limbo

House Speaker Wan Muhamad Noor Matha said today (Monday) that his legal team will have to listen to the opinions of the House and Senate whips about whether the joint sitting of parliament, to select the prime minister, scheduled for this Thursday, will be postponed.

 

The whips are scheduled to meet on Wednesday, he said, adding that he needs to hear the views of the eight coalition parties as well.

 

All parties and the Senate have been thrown into disarray after the ombudsmen decided today to ask the Constitutional Court to consider a petition challenging parliament’s majority vote on July 19th to reject Move Forward party leader Pita Limjaroenrat’s renomination as a prime ministerial candidate.

 

The ombudsman also asked the Charter Court to order parliament to suspend the prime ministerial selection process, until it rules on Pita’s renomination.

It was only a matter of time before the Vote on whether or not Pita could have a second vote taken would be appealed to the courts.  The sham of asking the entire parliament and the senate to vote on this was a ridiculous move and has further ramifications if left as it is for any other PM nominations.  Voting for a PM is not like voting for a constitutional amendment or a bill.

THE Ombudsman’s Office has decided to ask the Constitutional Court to postpone the next House/senate meeting scheduled for Thursday (July 27) until it rules on constitutionality of the last meeting’s vote to deny Move Forward leader Pita Limjaroenrat  a second chance to be named and voted prime minister on grounds it violated Article 41 of the House regulations, TV Channel 7 said.

 

This article of House regulations states that a motion dropped cannot be resubmitted in the same parliamentary session except for vote not having taken place but in Pita’s case there was voting at the first session on July 13.

 

At 2.30 p.m. Pol. Col. Keirov Kritteeranon, secretary-general of the Office of the Ombudsman, said some lawmakers and the general public had petitioned the agency to forward a case to the Constitutional Court to rule whether the vote in favour of applying this regulation by 395 MPs and senators on July 19 is contrary or inconsistent with Section 213 of the Constitution.

Not quite. The delays and postponements work in Pita's favour. The PT and the junta parties can't wait to get into power. They're going to have to wait. PT in a very awkward spot now, caught in the act with all their worst enemies.

I would have thought that there was extreme pressure to get something, anything done before the King's Birthday and a longish weekend.

 

But now it seems like everyone is looking for a pass, like Thai schoolchildren who clearly can't finish their homework, to avoid casting a pall over the celebrations.

The selection definitely needs to be postponed until the correct selection process is nailed down, specifically, can a candidate's name be submitted to more than one vote..

I just wonder what it takes for the electorate to realize, that they have been short changed for decades and cheated out of trillions of Baht. Thailand came a pretty long way to spell out a government and an opposition, i.e. a polarization of government functioning. 
But what I've been seeing over the last few elections makes me wonder, if not everything here is in "limbo", on purpose, to smokescreen the electorate as long as there is power and cash to be creamed off ......... at the voters expense?

I think most of them know it already. Whence the way the votes went at the May election (so many weeks ago now!).

This certainly could take months, but never mind, we are fortunate to have such a competent and highly regarded "interim government" to rule in the meantime. Ministers are still in place, decisions are still being taken, policies mooted introduced and carried through, budgets dispensed; the country continues to move forward - perhaps an unfortunate choice of words but there we go!

 

The further complication will be the delay entailed by boarding for and appointing a new Ombudsman. This chap certainly can't be in the job for much longer!

 

As you suggest, the whole business, thoroughly and effectively managed, has got to be good for a year!

If the coalition are sincere to each other they will agree to a postponement for Thursdays proposed election for a new PM until the courts meet and make a decision over the case presented to them

I think they will have to, no choice. They can't proceed in violation of any court order, or while it's sub judice, awaiting judgment.

They will change the law if it starts going against them as seen before. At the end of the day the People voted and decided to oust the Military. Rather than accept the decision they will cling to power however it takes. A bit like a jury trial if your in the dock for an offence where the jury will convict you, however if you dissolve that jury and replace them with friends you win your case.

The fact that no mention of Section 157 of the constitution is made seems to indicate that in the six years since the promulgation of the current constitution, the parliament has not yet issued the rules of procedure of the National Assembly.
