The 21 May discussions with the Judge on the Jury instructions definitely involve the "irrespective" clause in the FEC regs which would go way upstream to determine whether the 34 entries as in the indictment were actually false.

If the entries weren't false, what was the point of the meeting where the Trump Organization staff tried to figure out how to pay Michael Cohen without referencing the hush money payment?

Noted earlier from a 16 May Judge's conference Counselor Bove said as to the 'irrespective condition' : 

 

... which we think is an important issue for the jury to consider with respect to whether the payments at issue could be considered expenditures and /or contributions.

 

As you say, closing arguments next week.

It's normal for a judge to ask a hung jury to try a little more.

 

If the jury reports that someone is "not deliberating", they may be replaced in some venues. This means that a juror is not paying attention to facts, they have an opinion solely based on personal feelings, not the facts of the case.
