Divorce on overstay

Can divorce to Thai national while in overstay? During the process they will ask for the visa status? There is agreement on everything so court is not needed. Thank you.

Don't even think about it.

Exit Thailand via airport and clear up any overstay.

Return at some point visa exempt and attend to divorce.

60 day except stamp can be extended by 30 days.

Plenty of time to sort out the divorce side of things.

They will ask for my visa status? This is what I need to know. I need to sort this out first and after good bye Thailand.

Your passport will be examined as that is your identity document.

 

Follow the advice given. If caught on overstay anywhere but the airport imm counter on exit, you risk detention in a  very uncomfortable situation.

Clearly you are not taking overstay seriously.

Length of overstay? Only ask in case there is time ban.

Under 90 days= no ban.

When I got married they didn't care about my visa status.

I will be banned. I just want to divorce and bye Thailand. The local amphur will check my visa status? And can I divorce in any Amphur or should be the done where I made the big mistake of my stupid life?

Easier to divorce Amphur where you were married.

I think NOT.

I believe he has been trying to find some way out of his predicament for quite some time, including an Elite Visa.

But, one assumes, nothing he had hoped for has panned out.

So, then...Divorce is his most recent consideration.

 

Not a good situation.

If getting your visa legal tobe in Thailand.then i suggest you get a lawyer and sign the documents for divorce and the document granting him authority to act in your name for this... Pay the lawyer and leave without returning. This way you avoid having to be in a court room or amphur as an illegal in the country. The lawyer can sort it out with a fee.

If you don’t ever plan on returning then just leave and don’t look back. You don’t need to sign any divorce documents. If she wants to remarry or dissolve the marriage then she can do it on her own as per abandonment. Or risk going to jail for overstay. Up to you. Also consider not letting anyone know your plans on leaving if they are aware of your overstay status, just grab your stuff and go.

The OP should be concerned more with need for emergency travel doc if indeed that's required to exit Thailand.

Previous thread indicated pp expired.

In any event....OP "leave dodge"
