Hard to get a sense of what actually happened but it sounds like the wife was off doing her own thing disputing boundaries and fighting legal battles while he was blissfully in ignorance or just happy to let her get on with it.

 

The trouble is, Thai wives are often short of basic intelligence and are gullible to the extreme. They do such stupid things.

 

So many things that could be said about what he should and shouldn’t have done vis a vis assets and financial arrangements with his wife. No point to repeat them, we all know what they are.

She borrowed money for legal issues and somehow lost an apartment building from that ? How ?

The article doesn’t say it, but I assume she gave the chanote for the building as security for the loan. Then she didn’t pay the interest and the guy sold the moneylender took the chanote and sold the 1.2 million building for only 45k, obviously to an affiliated party. So the money lender got a 1.2 million building for only 34k.

 

i really don’t understand where the illegality of the wife’s actions come in. Although they were out of jail in 8 days so maybe it wasn’t illegal and the jailing was a warning not to kick up a fuss.

 

I think this is a story that will make no sense to a farang, even if we had the full facts

From what I read, a wife must at some point live together at the same address with you (in the USA) for at least 5 years (total - not consecutive ) before being eligible for SS survivor benefits.

The picture says it all. A conspiracy. This kind of thing goes on all the time in Thailand. The wife's actions will likely have been taken as a result of pressure on her from her relatives. This story simply confirms that foreigners should never invest more in Thailand than they can afford to lose.

Well, one could say they've been 'savaged' by Thai 'systems'. I agree with many here that there are significant details missing, therefore I won't dive in with opinions that are really unqualified. Whether she set him up, or is a joint victim, who knows? The message I take from this is: If you're in your mid-sixties, have worked hard and accumulated some wealth and decide to move to Thailand with a Thai wife, leave a chunk of the money at home and be prepared to give the rest away. Your old, you move here for a quiet life, an easy life. Don't be tempted to go out and make more money than you'll ever need in the years you may have left. I went for breakfast with some expats the other morning, three in the small group had experienced a heart attack either in their late 60s or early 70s. None of them were overweight with a couple of them being 'fit' cyclists. Anytime folks, our number will be up. I own nothing here in Thailand. Everything is in my wife's name so when I pop my clogs, there are no issues. The chunk of money in Australia is in my name and is covered by a Will in that country. My kids need nothing from me as they both earn good money in their own careers, e.g. my daughter is a geoscientist, at 26, on a package of $AU 165,000/yr. My wife is an Aussie permanent resident and speaks good English with a degree in tourism management and business. We were married in Australia, where we met, in 2019 and only moved to Thailand this year, at my suggestion. But always be vigilant, be a good judge of character, and never walk around without a shirt on. Me? I hate being around her family in a singlet, let alone topless. Who wants to look at a saggy barrel chest? 555  

When I came to Thailand 20 years ago i

spent a year prior looking at the risks involved I decided that I would take the gamble that the monies made on the sale of my UK property I would risk thankfully everything worked out fine my first property I sold at a good profit enabling me to build two separate properties however as I write I am well aware that it could all come crashing down with the click of a finger thankfully it would not leave me destitute and I would of course be upset but at the same time be grateful that I’ve enjoyed 20 good years and let’s face it there are no pockets in shrouds . Everyone who invests in Thailand do so at their own risk you only have to see that the government have already closed down more than a 1,000 weed shops this year someone once said to me never trust a Thai when it comes to money matters it appears this gentleman allowed his other half to take very big risks !

Now he's gonna gave to use the agent for his extension, cough

I was told that when I first visited the P.I. . Never invest more than you can walk away from. It's good advice.

If you own assets to the value of this couple you need to use a very proper legal firm to oversee all contracts pertaining to them, and make sure you hold the Chanote's in a secure place.

There is probably a lot more to this story than is revealed in the article.

 

This case is allegedly 15 years old, beginning in 2010.

 

It is inconceivable that a sane person would use a GBP 1.2 million property as security on a money-lender's loan of GBP 34,000.

 

Note the denomination of the loan as GBP, whereas Thai money lenders usually lend Baht.

 

If the loan was actually GBP it implies the money was for use in a UK legal dispute, and is not very much at all for Western lawyers who would normally demand an upfront deposit of GBP 100,000.

 

If this couple had to resort to a money lender for a loan, they were already in trouble when they received the loan in 2010.

They say it started with a boundary dispute, how come? All boundaries are recorded and officially stamped at the local government land office. They wouldn't have been able to register the land if it encroached of another person's.

His wife is in the property business. Seems she did some shady work herself and came back to bite them.
