He should of consulted with the Farleft extremists organizations that want to kill/US Burn/US down ! They/Them have tons of protesting legal experts . The statue: 36 CFR § 2.13 - Fires.

The Park Police said it arrested one person in the park at about 6:30 p.m., citing a violation of 36 CFR 2.13(a)(1), which prohibits fire in public parks, except in designated areas.

My guess is yes, the Supreme Court would RULE 6:3 because the Executive Order refers to "the American flag" and the plaintiffs would claim that the confederate flag is an "American flag".

 

And they'd cite the "incitement" clause in the Executive Order.

 

Notwithstanding the Supreme Court’s rulings on First Amendment protections, the Court has never held that American Flag desecration conducted in a manner that is likely to incite imminent lawless action or that is an action amounting to “fighting words” is constitutionally protected.  See Texas v. Johnson, 491 U.S. 397, 408-10 (1989).

Except in places with a burn ban on everything.  He'd have been fine if he tore the flag apart.  That's protected speech.  He started a fire where there are no fires allowed.
