Biden creating his Ministry of Truth was a failed attempt to ban discussion of the evidence of his families corruption. It was to censor truth. Absolutely Orwellian and pure fascism but forum lefties loved it.

Inside Disney’s Abrupt Decision to Suspend Jimmy Kimmel’s Show

The late-night host wanted to address the firestorm over his remarks about Charlie Kirk’s killing on Wednesday’s show. Company leaders worried it would make matters worse.

 

Kimmel, during his Monday show, had criticized how President Trump and some other Republicans were responding to the fatal shooting. Carr suggested during a podcast appearance two days later that the FCC could take action against the broadcast licenses of ABC-owned stations. 

 

Advertisers and affiliates soon called the network expressing concern about Kimmel’s show. Executives at Sinclair and Nexstar, owners of more than 60 local ABC stations, told network leaders after Carr’s remarks that they would “indefinitely preempt” the show starting that night, moves that would hobble the program’s reach.

Kimmel had planned to address Carr’s comments on his show Wednesday night, according to people familiar with the matter. Before his on-air appearance, Dana Walden, co-chairman of Disney Entertainment, spoke to the host about his plan, the people said. 

 

After the conversation between Kimmel and Walden, she and other senior executives thought that the star’s approach could make the situation worse, people familiar with their conversations said. Executives also discussed staff safety, including threatening emails staff on Kimmel’s show had received after Carr’s remarks and the posting of some of their personal information online, the people said.

 

Walden huddled with her team and Disney Chief Executive Bob Iger before the two executives decided to temporarily take “Jimmy Kimmel Live!” off the air, the people said. She then informed Kimmel of the decision.

RESTORING FREEDOM OF SPEECH AND ENDING FEDERAL CENSORSHIP

The White House
January 20, 2025

     By the authority vested in me as President by the Constitution and the laws of the United States of America, and section 301 of title 3, United States Code, it is hereby ordered as follows:

     Section 1.  Purpose.  The First Amendment to the United States Constitution, an amendment essential to the success of our Republic, enshrines the right of the American people to speak freely in the public square without Government interference.  Over the last 4 years, the previous administration trampled free speech rights by censoring Americans’ speech on online platforms, often by exerting substantial coercive pressure on third parties, such as social media companies, to moderate, deplatform, or otherwise suppress speech that the Federal Government did not approve.  Under the guise of combatting “misinformation,” “disinformation,” and “malinformation,” the Federal Government infringed on the constitutionally protected speech rights of American citizens across the United States in a manner that advanced the Government’s preferred narrative about significant matters of public debate.  Government censorship of speech is intolerable in a free society.  

     Sec. 2.  Policy.  It is the policy of the United States to:       (a)  secure the right of the American people to engage in constitutionally protected speech;

     (b)  ensure that no Federal Government officer, employee, or agent engages in or facilitates any conduct that would unconstitutionally abridge the free speech of any American citizen;

     (c)  ensure that no taxpayer resources are used to engage in or facilitate any conduct that would unconstitutionally abridge the free speech of any American citizen; and

     (d)  identify and take appropriate action to correct past misconduct by the Federal Government related to censorship of protected speech.

     Sec. 3.  Ending Censorship of Protected Speech.  (a)  No Federal department, agency, entity, officer, employee, or agent may act or use any Federal resources in a manner contrary to section 2 of this order.

     (b)  The Attorney General, in consultation with the heads of executive departments and agencies, shall investigate the activities of the Federal Government over the last 4 years that are inconsistent with the purposes and policies of this order and prepare a report to be submitted to the President, through the Deputy Chief of Staff for Policy, with recommendations for appropriate remedial actions to be taken based on the findings of the report.

     Sec. 4.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:

(i)   the authority granted by law to an executive department or agency, or the head thereof; or

(ii)   the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

     (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

     (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

In the USA, there is a clear distinction between ‘Broadcast TV’ and ‘Cable TV’. 
 

Broadcast TV space is publicly owned, and as such is heavily regulated by the FCC in regards to content and presenting an overall balanced approach at all levels of programming. This also includes some additional limits on the individual free speech rights as protected by the First Amendment. 
 

Cable TV is considered a private space with greatly reduced oversight by the FCC, and enhanced freedom for the individual networks to say and do as they desire. 
 

It appears that Kimmel while working for ABC (a publicly licensed network) was suspended due to his failure to adhere to the ‘Public Interest Clause’. 
 

Given he was employed in a public space at the time he made his comments, he actions are bound by this FCC clause. If he had made the same comment on a Cable network channel, any action or inaction against him would be at the discretion of his employer. 
 

Additionally, had he made the comments while doing a personal broadcast he would be free from most FCC regulations, though his employer would still be within their rights to suspend him if his comments where in violation of his employment contract or similar. 
 

A concern with the FCC Public Interest Clause is it is often subject to interpretation and for the past 15+ years has often been ignored. Given his employer took action against him, it would appear they understand their responsibility to adhere to their FCC licensing requirements and how the failure to meet those requirements can challenge their success as a business.

No one is arguing that Bob Iger does not have the legal authority to remove Kimmel's show from ABC, even if under the threat of extortion.

 

“But frankly, when you see stuff like this, I mean, look, we can do this the easy way or the hard way,” Carr said.

 

I think what people are concerned about is using the power of the Federal Government to silence those who make fun of you.

 

It won't stop here, and shifting the "blame" from trump to Kimmel is not going to work.

“Tucker Carlson is out at Fox News,” Democratic New York Rep. Alexandria Ocasio-Cortez gloated in a selfie video, posted after Carlson’s departure from the network in April 2023. “Couldn’t have happened to a better guy.”

 

......But, deplatforming works, and it is important, and there you go, good things can happen.” 

 

What did she mean, "deplatforming works"?   The lefties and Dems have been doing it for a decade (or more) and now they're butthurt when it happens to their side. 

 

Even if I don't like cancel culture, the most dangerous thing is when only one side is allowed to get away with it.  Maybe if it happens enough now that the shoe is on the other foot, the Dems won't do it next time.

When Kimmel made his comments he was not speaking in the Public Square (street corner, podcast etc), but as an employee of a Corporation that is licensed by the FCC that includes programming standards and Licensee  accepted limits on ‘Individual Free Speech’. 


As an employee he can still say anything he wants, but is subject to the response of his employer.

Again, no one is arguing that Iger can't remove Kimmel's show. I think Disney/ABC will have to pay out Kimmel's contract.

I’m fully aware of the authorship of the quote, with the point of interest being Kimmel was not in a ‘Public Square’ for those that may not understand (or choose to ignore) that Free Speech is not a 100% absolute right to say anything at anytime with potential consequences. 

 It would seem any pay out of Kimmel’s contract will most likely the job of one or more Courts and a gaggle of Attorneys to decide.

There is no such thing as a publicly licensed network. The FCC licenses individual broadcast TV stations. There are over 200 ABC network affiliated stations. ABC owns and operates 8 stations (O&O's) that are subject to FCC licensing: 

 

Disney owns eight TV stations under the ABC Owned Television Stations group, which are WABC-TV (New York), KABC-TV (Los Angeles), WLS-TV (Chicago), WPVI-TV (Philadelphia), KTRK-TV (Houston), KGO-TV (ABC San Francisco), WTVD-TV (Raleigh-Durham), and KFSN-TV (Fresno).
