We’ll have more on how the program will work, who is eligible, and how creators can access it soon.“

 

Jones and Fuentes may not be eligible to rejoin under the program even when it does get going. Jones was taken off YouTube prior to the pandemic in 2018 for violations including hate speech and child endangerment, and Fuentes was banned in 2020 for hate speech. [emphasis added]

While YouTube has every right to block whomever it pleases from membership, it's definitely unwise. Speech should be free. Extreme exceptions can be made in the commonly cited "Shouting fire in a crowded theater" but that should be literally construed. Not figuratively.

The same goes for Tiktok which also suppresses free speech.

The “shouting fire in a crowded theater” analogy from Schenck v. United States (1919) is no longer the standard for limiting speech. The Supreme Court abandoned Holmes’s “clear and present danger” test and replaced it with the “imminent lawless action” standard from Brandenburg v. Ohio (1969).

🔑 Today, U.S. law says:

  • Speech is protected, even if it’s offensive, dangerous, or false.

  • The government can only punish speech if it is intended to incite and likely to produce imminent unlawful action (e.g., telling a mob to immediately riot).

  • Simply causing anger, discomfort, or even potential harm is not enough.

So when people use the “fire in a theater” phrase, they’re usually misunderstanding the law — it’s more of a rhetorical cliché than a valid legal doctrine now.

Well, looks like the sad, partisan right-wing U.S. Supreme Court finally did something right for once. Color me shocked!

"Washington — The Supreme Court on Monday turned away an appeal by conspiracy theorist Alex Jones over a $1.4 billion defamation judgment against him for his false claims that the 2012 shooting at Sandy Hook Elementary School was a hoax.

 

In rejecting Jones' case, the Supreme Court leaves in place the record-breaking sum he was ordered to pay after he was found liable in 2021 for damages in lawsuits brought by the families of children who were killed in the massacre. Jones had separately asked the high court last week for emergency relief while it considered whether to take up his case. Justice Sonia Sotomayor denied Jones' bid to halt the judgment later Monday, likely because the Supreme Court denied his appeal.

is the end to the first amendment right there...no trial by jury 

the judge decided and instructed the jury not to listen to anything Jones said he was gagged in the court room  ,

plaintiffs awarded a ridiculous $1.4 billion.

This sets a very dangerous precedent..and  by the way Alex Jones did not kill anyone  or call for harassment of the families or poor done by FBI agents. He doesn't have $1.4 billion and the families will never receive that  but it was never about the money..it was always about shutting him up. (which will not work)

There is also the case of Mike Lindell (the pillow guy)

with a similar stupid amount of money and no trial for claiming that computers can be hacked.
