Another low level us district court judge gives  a temporary stay in the USA to the Maryland man.This is a procedural step in the criminal case, not a reprieve from deportation immigration proceedings continue separately.

In his ruling granting Abrego's request for a hearing on the vindictive prosecution claims, (Judge) Crenshaw focused on comments that Bondi's top deputy, Todd Blanche, made on Fox News the day of his June arrest on human trafficking charges, to which Abrego pleaded not guilty.

 

"Strikingly, during a television interview Deputy Attorney General Blanche revealed that the government started 'investigating' Abrego after 'a judge in Maryland . . . questioned' the government’s decision, found that it 'had no right to deport him,' and 'accus[ed] [the government] of doing something wrong,'” the judge wrote.

 

“Deputy Attorney General Blanche’s remarkable statements,” Crenshaw wrote, “could directly establish that the motivations for Abrego’s criminal charges stem from his exercise of his constitutional and statutory rights to bring suit against the Executive Official Defendants, rather than a genuine desire to prosecute him for alleged criminal misconduct.”

If you are saying the motion to dismiss can be appealed, I guess so. A non-guilty verdict in a criminal trial cannot be appealed by the prosecution.

One party , soft on crime,terrorist sympathizers, while excusing  millions of unvetted borders crossers entering  the country between border Stations ,while they wreck chaos on every institutional system  in our country.

 

Abrego Garcia is being represented by a top-of-the-line criminal defense attorney based in NY City.

 

Either they are working pro bono or someone is paying the bill.

More News on the foreign national from El Salvador , DHS has picked Liberia to deport ,after reaching a agreement with that country.

 

"The court filing said that Abrego Garcia could be sent to the West African nation as soon as Oct. 31 to fulfill a standing deportation order against him".

The latest move to deport him comes as Abrego Garcia remains in immigration detention in Pennsylvania. A federal judge in Maryland previously barred his immediate deportation while reviewing claims that the government is retaliating against him for successfully challenging his wrongful removal earlier this year.

 

The same judge wrote in an October order that his prosecution “may stem from retaliation by the DOJ and DHS,” while a separate case in Tennessee over human smuggling charges is still pending.

He can always fly to Costa Rica from whatever craphole the gub'ment deports him to.

Liberia will take him.  How many times can a non citizen be  allowed to reject a SCOTUS decision   of being sent to another country if one doesn't want to go back to his original country.
