The NY State fraud trial initiated by Ms. James was a civil trial and a bench trial with no jury. Trump et al were found liable as it was a civil not criminal trial with the judgment by Judge Engoron.

 

NB On September 8, the judge announced that the trial would be a bench trial (a trial by judge, not jury), and that it could last from October 2 until December 22, 2023. per Wikipedia

Amazing that you have such in depth knowledge of both US law and the specific charges against James that you are confident of a Trump win. Harvard law degree and clerked for a Supreme Court justice or something?

 

I think Trump loses and just ends up looking more like the vindictive little whining crybaby that rational people know he is.

 

I suspect, since there is absolutely nothing on Schiff, that the next indictment will try to get the Senator for sticking gum under his desk in 2nd grade. BTW, the Comey one pretty much blew up already. Nobody in the Eastern District of Virginia was willing to work with the insurance lawyer to bring the silly case to court, so DoJ had to grab a couple of junior prosecutors from North Carolina to do it, and they looked like fools in court on Wednesday. Making it even worse, the moron Trump meant to send a private message to his attack dog Bondi about indicting Comey and James, but goofed and posted it on his social media account (Per the Wall Street Journal edition of 7 October 2025). Presidents do not dictate what the DoJ does, so on that posted message alone, the judge will likely dismiss the case. James can do the same.

 

Vindictive and clever is a dangerous combination. Vindictive and incompetent makes it a clownshow. Trump might as well just attached the red ball to his nose and stop trying to hide behind some tough guy facade. He's a bozo.

There were plenty enough otherwise left-leaning legal scholars and former prosecutors who had reservations about both the civil fraud trial and the 34 varieties felony counts criminal trial as I frequently noted during the course of those trials.

 

My reason for that was not to protect then private citizen Trump but seeing him in court as a likely (again) presidential candidate maybe helped him win the election convicted or not.

It feels alot better living somewhere justice is being served. Isnt that right Tug?

Well I can tell you that he was convicted and legally a criminal felon. Also the first President or former President to be found guilty of a crime. That can't be erased from his criminal record. He tried to pardon himself but going nowhere as it was a state conviction. Anything else?

I have and both the two statutes in the charge contain the word 'knowingly' and one also 'willfully' which I guess is part of the career prosecutors' reservations.

Tish James: From Trump-Slayer to Mortgage-Sinner! What a 'Coincidence'!  This is immaculate timing. A career prosecutor was conveniently replaced by a Trump loyalist who immediately indicted the two people Trump publicly ranted about (James and Comey). This isn't law; it's the Art of the Retribution by a wannabe authoritarian.
 

It's a vengeance move pure and simple... James exposed Trump's multi-million-dollar fraud, so the DOJ is now hyper-focused on her alleged paperwork error from years ago... minions were ordered to 'find something'.  It’s a political quid pro quo: You sue my billion-dollar company, I'll sue your tiny condo paperwork. "No one is above the law," they shout, while selectively using the law as a glorified Mafia hit squad. Totally normal. Move along.

BTW, The jury of 12 New Yorkers delivered the unanimous verdict. The jury selection, but law, had to be approved by Trump's legal team.
