Any case would be ruled in an English court. The programme could only be viewed in the United States if someone took illegal steps to break terms and conditions of iPlayer, which is blocked in the US. It could not be seen by US voters, and therefore could not have affected the outcome of the US election. It was aimed at a British audience, who have no voting rights in  the United States of America since ever.

 

It was broadcast some years after the events. No false imagry or audio was used. No one changed their mind about the US President as a result of the footage. It could only be accused of clumsy editing. No harm can be demonstrated.

 

His Lawyer are claiming jurisdiction under Floridian law, on the basis that the President is a resident of Florida. Until the Daily Telegraph published the story on its website, which is available to subscribers in the US, the defamation, if there was one, only occurred in the UK. ergo no US defamation occurred and US courts toss it out. The Daily Telegraph is the third party, and by publishing the story in the US, either through written explanation or replaying of an unauthorised clip, they would become liable for the defamation.

 

Moreover, the US applies special rules for public figures (a grey area), effectively they are fair game for ridicule, mockery and made up statements. Hence no one is suing the President for various falsehoods he has stated over the years, in order to win electoral favour, about his opponants. All kinds of statements are said in public discord, some funny, some offensive. When Elon Musk was sued by a British cave diver in Thailand for alleging he was a Paedophile, Musk won the case. Part of that case was won on the basis U.S. defamation law gives greater protection to speech about public figures or matters of public interest, requiring at least “actual malice” (i.e., that the defendant knew the statement was false or acted with reckless disregard for the truth) when the plaintiff is a public figure.  The lawyers for the Plaintiff would be hard pushed to argue that what Panorama did produced an interpretation that was any different from what is generally held by the wider public, that the crowd was incited. In addition, during court cases of the terroristic mobs that broke into the Capitol with the intent of lynching or murdering politicians that they disagreed with, many would claim they were at least encouraged by the President to attack the Capitol. He might argue that's not what he meant, that people misunderstood. But Panorama's editing didn't change the interpretation of what many people felt on the day, who were listening to him in person.

 

The January 6th Select Committee found Trump was the “central cause” of the attack on the Capitol. Now the members of that Committee might be dismissed as biased political hacks, who enjoy protection from the laws of defamation.

 

The Panorama programme was broadcast to the British people in October 2024. Legally, Americans inside the US only became aware of the contents of that broadcast once the Daily Telegraph republished excerpts, without permission, many months later. Before then, the programme could only be viewed in the US by using illicit means. 

 

Overseas US voters voted in September 2024, a month before the Panorama broadcast. They could not have been party to the contents of that programme.

Of course, just because these domestic terrorists claimed this in their defence, it doesn't mean that the courts accepted that.

 

There have been perhaps hundreds of reports along the same lines, by members of the media, or the public, plus the President is facing lawsuits himself from former Capitol Police officers over his role on the day. He of course denies a role, but also by freeing all these terrorists, is suggesting these events never happened.

 

I'm not sure he could show his reputation was harmed, given that his reputation was previously based on bragging about assaulting women in a recording with Billy Bush (only part of which has been published, and a court might want to hear the rest), the court case regarding is sexual assault of a woman, his record of fraud ommitted by individuals in his companys who were alllegedly acting on his behalf. Not to say his association with what is likely the most notorious pedophile in modern history (easily outstripping Savile). US Law says for Public figures, he has to show actual harm (he is alleging that the programme, broadcast to British voters, was intended to affect the US election. He won the election). In addition, he needs to show "actual malice". Actual Malice is if you knew it to be false. But previous to the programme, US politicians, after an investigation found the President had incited the crowd.

Widely reported. The President might argue, and he has done, that the Committee was politically biased against him, but Panorama did nothing to lead to any other different conclusion.

 

Negligence is a defence. Panorama could say they didn't check further why the Department of Justice hasn't followed up on the recommendations of the Committee. That might require obtaining documents from the DoJ to find out why. Their mistake. Has Panorama  ignored evidence contradicting the chare of incitement; difficult. There are lots of statements by politicians, policemen who were there on the day, the defendants themselves, that would seem to support the supposition. Of course, being a widly help opinion does not mean a defamation could not have occurred, but there is the Rhetorical Hyperbole defence.

 

Its not straightforward. Meanwhile the Telegraph might actually go under. Its been pretty muc bankrupt for years. It was a paper I subscribed to for over 25 years, until they started Tabloid-esque sting jobs to ruin perfectly decent Tory MPs, in an effort to undermine David Cameron. Ironically, the Daily Telegraph worked with Panorama to "expose" Tory MPs (Patrick Mercer, and the Fiji affair). Donald Trump would face legal hurdles in launching a $1bn lawsuit against the BBC over “defamatory” statements on Panorama, partly because the documentary may not have been aired in the United States.

Under defamation laws in Florida, where the US president has threatened to launch his case, Trump: A Second Chance? must have been available to view in the state for a lawsuit for damages to be filed.

 

If it wasn’t shown on iPlayer in the US, or on the broadcaster’s global feed, media lawyer Mark Stephens said it could create an early stumbling block for the US president. He also said Mr Trump’s team could struggle to prove “additional serious harm” to his reputation, and that he might want to avoid further focus on his conduct from a court case.

Judge Steven Merryday gave the president’s lawyers 28 days to refile the suit.

 

Judge Merryday, in a blistering four-page ruling, said he was throwing out the suit because it "unmistakably and inexcusably" violates the rules that govern civil lawsuits. 

 

"A complaint is a short, plain, direct statement of allegations of fact sufficient to create a facially plausible claim for relief and sufficient to permit the formulation of an informed response," he wrote. What a lot of the lefty loonies are missing is that Trump is suing as a Citizen of America - he has the legal right to seek defamation remedy against the persons involved and the owners of the show itself (UK Govt). 

 

What is happening right now in so many cases and situations in USA is that the left are being held to account for their past behaviours and tactics - defamation, lawfare, deceit, illegal stock trading, lying to House and Senate Committees, and this includes the media.  Like most lefties who believe that killing Charlie Kirk was OK, they have acted in ways that are illegal - but they see them as justified because of their political beliefs. Interfering with ICE removing illegals is getting them arrested and Federally charged and some will spend time in a Federal jail - this is a massive shock to lefties who think they can do anything they like to achieve their political aims.  After all - who can blame them after all the riots when Clinton lost and when BLM started and many other cases, when there was very little legal punishments handed out - the local Democrat politicians in many cases saw the riots as justified.  But when conservatives (stupidly) enter the Capitol to protest they are arrested and charged with (unarmed) insurrection and many jailed.

 

The next step (2026-2028) in this process will be the arrest and charging of Democrat politicians who have committed illegal activities, including inciting their supporters to riot and to block ICE Agents.  The punishment of illegal activities is what will stop all the BS that has been going on for far too long by left wing politicians and supporters. Not saying it doesn't happen on the right - just nowhere near as much.  George Floyd was killed and there were massive riots and people were killed.  Charlie Kirk was killed and there were no riots - the only violence was lefties destroying shrines for Charlie and things like the recent attacks against TPUSA members at Berkeley Uni.  There is one side in USA politics that needs to be pulled down and punished - and it is obvious to anyone which side that is.
