What if leave country during 90-day notify grace period?

Featured Replies

I re-entered Thailand in Oct and my 90-day notification is due Dec. 18. Since it will be the first notification after re-entering, I must do in person at CW. However, I plan to depart again on Dec. 19 or 20, during the 90-day grace period of 7 days.

So do I need to do the notification?

Appreciate hearing from someone who was in this situation.

Thanks.

You are mixing up a couple things 😞

First off the way the rule is written is if you're on a visa/extension that requires a 90 day report and you are in the country 90 continious days you report, period end of story.

There is NO grace period for in person reporting..

There is a "window of opportunity" to report and that just so happens to be from 2 weeks before the due date until 1 week after the due date.

So by looking at your post you have a 90 day report due Dec 18th and because it's the first report due after returning to thailand it has to be done in person (or by mail or someone does it for you). You have from 4th of Dec to the 25th of Dec to file.

Now as to your "I'm leaving the 19th or 20th" conundrum.

Even though you are obligated to file a 90 day report (because you've been IN the country 90 days) nothing is going to happen to you when you stamp out of the country at passport control leaving. Those officers don't care at all if you ever filed a 90 day report or not..
AND
When you come back your next 90 day report will be due 89 days from the date you stamp in (because the day you stamp in no matter what time is counted as day one). It is highly unlikely that the immigration officer will notice you failed to file a 90 day report last time before you left (although if they did they could fine you 2000baht before they would let you file the new 90 day report)

I'd say you're fine to leave and nothing will happen when you go to do your following 90 day report

I just wanted you to know how the rules are interpreted and to get that "leaving within the grace period" idea out of your head 🙂

Off topic but 90 day report related.

Recently some had been asking if you exit Thailand and do online report will it be accepted.

The answer is NO.

I left Thailand Nov 7. Report window open 19.

So I did the report online.

Now in Saigon and result from online report : REJECTED.

Reason : Foreigners have departed the kingdom.

I will do it via mail 75 days after return.

How can that be?  Even if you entered on 1 October your 90 day report would be due on 29 December.

I thought this question was familiar.....you already asked it a couple of weeks ago!  Except then it was September you arrived, now it's October.

I'm sorry, I meant Sept.

Yes, I did, but then it occurred to me that  my planned departure falls into formal grace period so that may make it okay.

No.

However as advised I wouldn't bother with report in your example.

They must have improved their system for checking that as it's exactly what I did in September.  However, the earliest due date from that out of country report was just reached and my online report rejected with the message

"This online application can be submitted 15 days in advance until the due date of notification."

So it appears they know I'm back and too early for the "real" date.

I did it just to check against questions being asked on forum. My dates aligned.

So I did the online repport when window open and I was in Oz.

Now in Saigon.

Report rejected.

They reason : foreigner left Thailand.

Those clever IT dudes.

Never thought I would type that about Thailand.

FYI, yesterday I did notification at CW just to be safe. Officer told me that you do not need to do notification if you leave country during the 7-day grace period.

Will the next officer agree? The regulation is quite clear.  90 days in Thailand means a 90-day report.
