U.S. President Donald Trump said on Tuesday he is terminating all documents, including pardons, that he said his predecessor Joe Biden had signed using an autopen, a move that legal experts doubted would hold up in court.

The autopen is used to replicate a person's signature with precision, typically for high-volume or ceremonial documents. It has been employed for years by presidents of both major parties to sign letters and proclamations.

 

All rather childish and spiteful. I guess equally Democrats can reverse all Trump's Executive Orders if they gain power.

Just to note, as there has been a recent comment that the Biden autopen pardons got cancelled, that President Trump's saying 'hereby' terminating all Biden autopen pardons "with no further force or effect" (as above) is really moot point until someone, upon receiving such pardon, has to be released from federal prison following a conviction or there is some new legal charge/indictment against someone, say Ms. Cheney, who has received a  pardon to any future specified legal morass.

 

Everything else is just hot air.

Sorry -- it will be hard to determine whether Trump actually did terminate any Biden pardons until there is a test case.

Well, so far the Trump administration hasn't moved to carry out Trump's threat. I suspect it's an empty one. The supreme Court already ruled on this in a case called ex parte Garland

Seems to me the simple question here is, can a sitting president invalidate a prior president's pardon for any reason.

Revoking a prior president’s pardons would be unprecedented, and if people’s pardons are revoked, they could challenge the revocation in court, with legal precedent on their side.

Will SC? That would require DoJ to prosecute someone for pardoned crimes. Do you really think they'll try that, knowing they themselves could be next?

If the President didnt know or or sign the pardon, it wasnt a pardon. You need to start applying logic and thinking through matters yourself.

And knowing they could be next didnt stop deranged democrats waging nonsensical and highly coordinated lawfare against Trump, which sure as heck backfired spectacularly. Not the sharpest tools in the shed.

Yes and when the motion is filed by the defense based upon the pardon received, the prosecution reply may be we are contending that, at the time the pardons were issued, President Biden was non compos mentis and wouldn't be able to tell you what planet he was on.

Which would be a claim that can't be proven. There's options to remove a mentally unfit president.

Even before that, the Court may say in THIS court we are not in any position to invalidate a Constitutional right of the President so that matter stays until some further Court says: We agree. Biden was nuts. Pardons invalid.
