Late 90 day police reporting penalty

Featured Replies

I am embarrassed to make this post, but the spouse put the wrong date on our house calendar for the 90 day reporting and now I'm almost 1 month late reporting.  What are consequences of this late reporting?  Thanks in advance everyone!

Go to immigration as soon as possible, think its a 2000bht fine.

Plus, look after important stuff yourself.....🤫

Don't go to immigration as soon as possible.  That's a waste of time.

The fine is 2000 baht, whether you are 8 days late or 8 months late. Same 2000 baht.

So now you are on bought time.  That means it benefits you absolutely none at all by going just to pay the fine.  Wait until next time you already need to go to immigration for something else and pay the fine and do your next TM47 then.  You might even get to skip another report or two as a benefit.

There are actually people who never do 90-day reports and just pay 2000 baht each year at the time of their extension. I'm not advocating for that, I'm just saying it's not a huge deal that you missed your report and there's no need to rush to fix it.

The good news for you, is the fine for failure to file a 90-day report on time is 2,000 baht and that does not go up whether you're 8 days late or 8 months late.

You have two choices,

Go to your immigration office file a late 90-day report and pay the 2,000 baht fine now
OR
Do nothing until you're going to apply for your next yearly extension and just pay the 2,000 baht fine at that time and file a late 90-day report.

Those would be your choices.

Don't forget to deduct the 2,000 baht from your wife's housekeeping allowance.

OP, good answers from Brandon and Tod.

Don't beat yourself up.

Personally  I would wait till I had business with immigration even if that was not till next annual extension.

Bit depends on the office and travel time etc.

I deal with CW and while the staff are fine the trip and building itself is an expedition.

Officially, according to section 76 of the Immigration Act, failure to submit a 90 day report is as follows;

Section 76 : Any alien, alien, who fails to comply with the provisions of Section 37(2),(3),(4)or(5) shall be punished with a fine not exceeding 5,000 Baht and with and additional fine not exceeding 200 Baht for each day which passes until the law is complied with.

However, the usual fine is 2,000 BHT, and I've never known the additional 200 BHT a day fine enforced.

Done it a few times myself. At immigration say “how much for no receipt?”  The answer is usually 1000฿😉

I'd possibly add, if you have any flight out of Thailand planned in due course, leave the Country and once back the 90 days will be reset.

I will just add that last week I watched a youtube video (yes, I know..) with a lady who had been 13 years in Thailand, using an agent for her 90 days report, who again (both) forgot her very last report before her yearly extension. She got into all kinds of trouble, and was finally denied extension on that ground.

Now, this may be bs, or there might be more to it (probably), but personally I wouldn't risk my extension, so I would do the late report at least before my yearly extension, if this was me. Just to be sure. It just takes a short time at immigration, to put this to rest.

Just my 5 baht on this matter.

Not credible.  There's obviously far more to the story.  An extension for someone who has been in Thailand for years is not going to be denied over a missed 90-day report.

At the Pattya/Jomtien  office they will fine you and put a nasty stamp in your passport (for free)

If you get involved with police for something, could they check this? My understanding was that if they see you don't have a valid extension they will hold you for that.

Yes they can and it's different than just doing an overdue TM47 at immigration office where you would be fined 2k.

What you outline can be fine of 5k

Penalties outlined in this guide

If you don't have a valid extension, you're on 'overstay'.

Just put I K in your passport and go to immigration, I wouldn't want it hanging over me, don't forget to blame your wife, better still send her.....:coffee1:

I almost slipped up, I thought my extension date was tomorrow, luckily I realized this morning, on a side note, something new today, got interviewed  and asked what my job was before living here, pissed me off a tad, so I said mind your own business, lost in translation he thought I just said business, he replied "Oh Ok ".. no more questions   :cheesy:. I stopped work 20 years ago......🙄

Good example of not what to do.

Sensible folk deal with immigration officers in polite manner. Being rude for no reason

Agree, I'm a guest in the country no matter how long I stay here.

You're only a "guest" if you've been invited.  Better to call yourself an alien.

Didn't really mean for this to blow up beyond my original question.  Thank you all for your responses.  Moderator, can you please close this thread.  Thanks!
