BANGKOK, Dec 10 – Caretaker Justice Minister Chaikasem Nitisiri said today that the resignation of the caretaker government including prime minister Yingluck Shinawatra would be a breach of the Constitution.

Flatly rejecting protest leader Suthep Thaugsuban’s demand for Ms Yingluck to relinquish the caretaker position, he said the caretaker Cabinet members are bound by the royal decree to assume their responsibilities and their resignations would be in violation of the charter.

The stipulation (on a caretaker government) is clearly stated in Section 181 of the Constitution to avoid vacuum in the country’s administration, he explained.

Mr Chaikasem said Mr Suthep’s proposals on an interim government and people’s council were unlawful.

Mr Suthep is not empowered to issue orders to Cabinet members, civil servants and government officials, or set up a volunteer unit to work in place of the police, he said.

He said Mr Suthep is violating the royal power in announcing the formation of a government and Cabinet while the present administration remains in charge.

The caretaker justice minister said the authorities would arrest Mr Suthep on insurrection charges if they could approach him.

Somsak Kiatsuranond, former Parliament president, said Mr Suthep should be realistic and abide by the charter in making political proposals and resolutions for the country.

He called for dialogues to find acceptable frameworks before the general election is held, saying it would be worrisome if the Democrat Party boycotts the upcoming polls. (MCOT online news)

Well, gentlemen (and ladies), from right this minute on, since HM the King has approved the Royal Decree for parliament dissolution, set Ms Yingluck as caretaker PM and ordered elections for February 2, everytime Mr. Suthep will call for her to retreat from her post and call for a people's council, he will be in direct contradiction and disobedience of the Royal Decree of HM the King of Thailand.

His only option is now to obey to the Royal Decree, withdraw all his crazy ideas or otherwise face lese majesty charges.

Indeed, Thailand has not been lucky with its politicians on either side of the fence. Getting PTP to be sensible in what it puts up during the campaign is a real worry. Why would they abandon what has worked for them before ( although taking the country into very deep water)

Lot's of legislative decisions only become law after Royal Endorsment. It's not the case that violation of those laws constitutes Lesse Majeste. What does so constitute it is clearly articulated if sometimes not clearly interpreted or applied - or so I've heard.

Suthep + Co are as much hated in the north/east as the Shinawat clan in the south and in Bangkok.
Both sides have very dirty hands and are power- and money hungry.

The constant agitation - polarization of the old cliques bring the country any further.

Would be good if both sides would rename a few temperate, honest people to concrete measures to combat corruption.

Central, North/East and South.

That would mean, that then the North/East comes not so easily to fresh money. (to finance there more then idotic schemes).

Elections will help little if Bangkok and the South have ongoing the feeling that they are will further robbed.

It must be prevented that a country can be completely plundered by a few unethical people just because they are currently in power.

They should first consider together how to repair this system, and after then elections

A bit far fetched to try and compare Suthep to Jutaporn, I think!

Anyway

There is no law allowing Yingluck to resign but there is a law against suggesting proposals for a new constitution or caretaker government. Surely this is blatant twisting of the laws meaning? if there is such a law?

I think the next 2 months will see the caretaker government enact what they couldn't as an elected government. Probably claiming to not do so would be against the Royal decree for a caretaker government, and leaving themselves open to claims of lese majeste for not following the decree!
