tinytot Posted May 30, 2006 Posted May 30, 2006 After my last post here about bringing g/f to Australia for giving birth well she has decided against travel so that has cleared that up. When my g/f gives birth does that mean our baby is dual nationality? Being born in Thailand with an Aussie father? Her doctor had asked for copy of my birth certificate for when the baby is born, Does he or she being the baby become a dual citizen automatically? Want to try and clear things up on behalf of when we apply for visa 6 months after the baby is born for travel to Australia do we need visa for baby? If can get some answers i appreciate the feedback.. Thanks Tinytot
vinny Posted May 30, 2006 Posted May 30, 2006 Australian citizenship by descent to people born outside Australia is not automatic. They may apply for registration as an Australian citizen by descent, if they meet certain criteria. See I was born overseas to an Australian parent. Am I Australian too? and Citizenship by Descent. See also AUSTRALIAN CITIZENSHIP ACT 1948 as amended, SECT 10B Citizenship by descent and SECT 5 Interpretation (1) child and (2) responsible parent. See also The Australian Citizenship Bill 2005, Australian Citizenship by Descent.
vinny Posted May 30, 2006 Posted May 30, 2006 If the child's mother is Thai or a permanent resident in Thailand then her child will be Thai too. See Thailand’s Nationality Act, Section 7.
Simmo Posted May 31, 2006 Posted May 31, 2006 Does he or she being the baby become a dual citizen automatically? You'll need to apply for citizenship by decent for the child at the embassy. Details from there website here.
