i´ve read most of that case but i think mine is a bit different and want know some opinions.

i´ve been 1 year in thailand and ve been together with my thai gf for 8 month. i am an german passport holder and now in sydney with an 1 year working holiday visa.

my gf tried to aply for a 3 month tourist visa to OZ and we didnt expected that they wont let her in.

they ask her why she should trust me? i offered support while she stay here in OZ and transfered the money for the ticket to her account. she showed the pictures and emails of us to evidence our relationship.

now i try on monday to call the lady in bkk who rejected her visa. and ask her what else is required to get her the visa.

would it be easyier if i fly to bkk and we aply together?

she is going to sell her land on monday worth of 20000AU$ (is not the reason but is that helpfull to get visa?)

i would be appreciate about some opinions.

I don't really know about Aussie immigration law, but, as a general principle, it's probably better for your girlfriend to not sell her land. To do so now makes it look as though she's selling up with a view to moving lock, stock and barrel.

Your g/f should have been given written reasons as to why her application was rejected.

Tell us what these reasons are and we may be able to advise you further.

here the written reasons:

in reaching my conclusion in this regard i found your travel plans in conflict with you general circumstances. i considered that you are unable to provide substantive evidence of employment and have concluded that your employment situation offers little incentive for you to return at the end of your authorised stay or to abide by the conditions of your visa. in addition i considered that the cost of your proposed travel represents a substantial monetary investment on your part that is inconsistent with your earning capacity and your demonstrated financial resources as well as your general.

you were unable to substantiate the existence of your claimed relationship with Mr. Tamas also declared in your application as T. B. whom you claimed that he has offered to support for your planned visit to a degree sufficient for me to conclude that the offer has sufficient substance to convince me that you intend a genuine visit to Australia. this she give me for paper and As either: 1. you did not include the particulars of a close relative in your application 2. the relative you included the particulars of in the application is neither an Australian citizen nor a permanent resident; or 3. the relative you included the particulars of in the application is neither your parent, child, brother or sister. and she say ; this decision to refuse to grant the visa for which you applied is not a decision that can be reviewed by the Migration Review Tribunal. please note that no further assessment of this application can be taken at this office. you shouls also note that under the Migration Act 1958, the Minister does not have a general discretion to intervene in migration cases, but rether has the power to intervene in the public interest where an application has been refused and where the refusal decision has been upheld at merits review. if you still wish to visit Australia, it is open to you to lodge a fresh application if you feel that you can provide sufficient evidence that you meet the critteria for the grant of a visitor visa i encourage you to carefully consider this option, as there is no refund of an application charge if it is not successful. Without prejudice to the outcome, experience shows that if a fresh application does not contain any new information, it is unlikely that the decision would be any different.

for me sounds hard.

It seems that she does not have enough finances to convince Immigration that she can support herself whilst in Oz and that she has not sufficiently demonstrated her need to return to Thailand.

She therefore cannot travel to Australia as a tourist on her own, she needs somebody to provide the necessary support.

The strength of your relationship is very doubtful and for a successful application to be lodged, you need to look at and meet the proofs of relationship as listed on the Immigration web site.

If you intend to try again, I suggest that you take a lot of time building your relationship so that it cannot be questioned and preparing a strong application. Read as many of the other posts on this forum relating to Aussie tourist visas, and be guided by the information contained in them.

We changed our plan:

i am doing my job here in sydney until august. then i intend to fly to BKK and get her a visa to germany for 1 month. we visit my family and come back to BKK in Sept. after that taken steps should be our relationship not doubtfull and at aply for her to OZ i can show my sufficient money to support her while stay in sydney.

this i feel is an stron idea, isnt it?

the mouse is right dont sell the land

she needs to have a compelling reason to return to LOS

she needs to have the means to support herself or someone willing to do so, you as a non citizen would not be viewed favourably and from memeory cannot sponser her.

but here is a twist why not increase her bank balance slowly to an amount of say $5000 the money amount but could be enough to sway the CO

in my experience though once refused is a second really hard look by the devil herself "gemma jackson"

You cannot sponsor her if you come here on a working holiday visa, so she will have to apply as an unsponsored tourist. She will need to show sufficient funds for the trip in her account. She will need to provide a reason to return.

You can add a letter to her application showing that she will be staying with you and list the address and whoever you are staying with and stating that you are prepared to assist her with accommodation and other costs while she is here and that you will ensure that she will abide by her visa conditions. You will still need to show proof that you have known her for at least 6 months. This will take letters and photos etc...A letter from who she will stay with while you are both here, stating that they will supply lodgings for her may also assist. I wont say that this will guarantee the visa but it may help towards making the application stronger.
