BANGKOK: -- The Centre for the Administration of Peace and Order (Capo) on Tuesday warned the Constitutional Court not to overstep its authority in its delivering of a ruling against caretaker Prime Minister Yingluck Shinawatra and her cabinet otherwise there may be chaos.

In a statement read by Tarit Pengdit, secretary of Capo, said that the Constitutional Court had already set a precedent when it ruled on the status of then prime minister Samak Sundaravej and only Samak lost his premiership while his cabinet continued to function.

Since Samak’s case and Ms Yingluck’s case are similar, the ruling by the charter court on the latter’s case should be in the same direction – that is the ruling is binding only to the prime minister, said Capo.

Capo charged that there was an attempt by some elements to create political vacuum so that a non-elected prime minister would be appointed to replace Ms Yingluck. It called on the Constitutional Court to do its job in a straightforward manner and to adhere to its ethical code of conduct.

Capo maintained that its warning to the court was not an act of interference in the court’s affairs but merely wanted to pre-empt possible unrest which may result from an unfair ruling.

Samak was kicked out since he did another job which he got paid for while he was PM and lied about it. The rest of the cabinet wasn't involved.

Yingluck's case is different. Most of the cabinet was voting for the illegal transfer of Thawil.

Well, since this government is so horrible, it looks like the CC is going to set another precedent and remove the entire caretaker cabinet. Yingluck testified it wasn't her fault but that the cabinet made the decision. Damned them out of her own mouth..

Another example of PTP/UDD threats that they say are not threats. e.g. "Something terrible is going to happen to you if you don't do as I want you to do; but that is not a threat".

The CC court needs to issue a statement saying, "CAPO is not my father".

Once again PT, Thaksin and CAPO overstep THEIR boundaries by threatening/warning the Courts . . . CAPO has &lt;deleted&gt; all to do with anything other than maintaining peace and order during the ISA . . . they (should) have no influence and no opinion on what the Courts do or do not do. So, your'e fine with a PM breaking the law? How much can he accept from another employer while he is PM? 20,00, 50,000, a million? It's a slippery slope once you ease the rules for this or that infraction. You then set a precedent where Yingluck could point at Samak's case and say, "See, you didn't punish Samak for his violation of the constitution"

You can't give politicians an inch or they will take a mile. Already the courts were too lenient when Thaksin hid his wealth with his driver and maid>

They seem to be very fond of intimidation, they are not used to someone questioning their integrity or giving orders, unfortunately, little do the spivs know ,in a democracy , they work for the people, therein lies the problem.

Perhaps CAPO should take it's own advice.

What right does CAPO have to warn the CC. Their job is to maintain peace and order and should br out warning the factions that whatever rulings are made the people must respect the courts decision. The CAPOs warnings are threats in themselves to the courts and should be punishable for intimidation.

Unless I'm much mistaken, it's not CAPO's function to tell the Constitutional Court, what they can or cannot do. wink.png

This constant pressuring of judges and courts might easily be mistaken for a coup-by-intimidation, to me.

It would be better if they were telling the judges to make their judgement independently, based on the laws & current Constitution, and leave CAPO to worry afterwards about public-order or keeping protests (pro & anti-government) peaceful and within-the-law. coffee1.gif

exactly why this country needs reform, we have the bully tactics from PTP trying to threaten and sway the judgement of a court - they just don't quite grasp the concept that this is fundamentally wrong no matter how you look at it, anyone making such threats should be arrested and jailed, if a court could be swayed with such tactics there would be no point in having a court/judicial system at all

The court should disband the whole lot of these useless bent cretins today - Thailand would be a much better place with them.

Next investigate all of them and expose the stolen billions they extorted from the Thai people and lock them up for life

You might want to consider who else was involved to understand why there was no investigation . . . it wasn't just Suthep involved . . . but yes, if the law is not applied impartially, then there is reason to make changes to the law, the constitution and those that enforce those laws. But let's do it in such a way that the public is involved in the entire process and has a say about what and how those laws should be changed.

Crazy idea, but perhaps we could have some reforms first before elections, so that we don't end up back in the same situation as we've had the last 10 years with elections, protests, people removed, new elections etc . . . perhaps we could also have some laws that say if a Politician is found guilty of anything illegal, they are banned for life, with no Parliamentary immunity . . . and then enforce those laws correctly. That would see Suthep out of Politics . . . along with many, many other corrupt individuals and families.
