Senator threatens to sue acting premier
The Nation

BANGKOK: -- Senator Paiboon Nititawan yesterday threatened to take legal action against acting Prime Minister Niwattumrong Boonsongpaisan if he insisted on scheduling the election date with the Election Commission (EC), as he did not have the authority.

Paiboon cited a Constitutional Court ruling earlier, barring charter court chairman Charoon Intachan from joining a selection committee to nominate Election Commission members because he had not yet been royally endorsed.

The senator also said that Article 5 on a Royal Decree to schedule an election date clearly authorised the prime minister and the EC chairman with the responsibility, which Niwattumrong could not discharge because he did not have the authority, as he is not the PM.

EC member Somchai Srisuthiyakorn said at the next meeting with the government, the EC wanted to resolve two issues: whether the acting PM has the right to countersign the Royal Decree on scheduling the election date, and whether the EC has the authority to inform the PM to postpone the election in certain eventualities. The agency also wants to know if security agencies are ready to provide safety to voters to ensure that the next election will not become another wasteful exercise.

He said it would be impossible to schedule the election on July 20 because there was not enough time to seek a Royal Decree on scheduling the election date. He also voiced concerns that anti-government protesters would disrupt the meeting between the EC and the government again.

Pheu Thai Party spokesman Prompong Nopparit said the EC must hold a video-conference within next week to schedule the election date or it may face complaints for dereliction of duty.

If the PM does not have the authority to request the scheduling of the election, the EC will deny the request.

One would expect this senator who is trained as a lawyer and was a "consultant" to the Constitution court to understand that basic procedure. However, as this man has been at the forefront of the attempt to bring down the elected government since the protests started, it shouldnot come as a surprise. In case anyone forgets, he was one of the early supporters of Suthep.

The EC from all accounts is running the country , so let the EC get on with their job , this business of threats, intimidation do nothing to bring respectability from the people back into the government, nothing is worse than listening to a lot of moaners giving their un-helpful opinions, the PTP are getting to be experts at this practice , let the EC do it's work, they know the laws, they don't need others to shove it down their throats. coffee1.gif

the EC wanted to resolve two issues: whether the acting PM has the right to countersign the Royal Decree on scheduling the election date, and whether the EC has the authority to inform the PM to postpone the election in certain eventualities.

This is more than reasonable in light of the PTP / CAPO / UDD constant threats of arrest and prison towards the commissioners if anything goes wrong.

Just like Feb 2 when the EC almost begged the government for 2 months solid leading to the election date that it was a mistake to go ahead on Feb 2nd... they were constantly ignored and threatened... The EC predicted correctly and the response from the government was that they blamed the EC and threatened them with lawsuits to sue for the lost money and also dereliction of duty and jail time.

The EC have the right to insist on legalities and to cover their backs if the government tries to force them to repeat the same mistakes as the last time.... which the government are surely already demanding with full UDD and CAPO backing and threats of prison.

Hmmm how good this looks on the world stage. They must be hoping that Westen diplomats and governemts and Medai are taking hard drugs not to see through this week.

Games up.

All courts and complicit "partisan" bodies through full weight behind their leader "Suthep"

EC blocks cancels and stalls elections then threatens TV stations who report this appears wrong. Then threaten to sue anybody who tries to get an election date sorted.

The retired Generals (Men of State) last week state anybody opposing them should be destroyed and miss world appointment (no way she won that) wants over half the country executed or banished.

Here ladies and gentlemen are the Elites in all their glory. exposed to the full glare of the worlds media and attracting the scorn and derision they always deserved.

And the reason they are so public is that they have failed. The plan was never thought past a quick "cause a riot, suck in the police to quell it, scream oppression of "Right to Protest", have the army come to the rescue and all the Elites live powerfully ever after"

Miss Thailand did not want half the country executed or banished, as half the country are NOT red shirts. There are maybe 10,000 red shirts nationwide and that accounts for 1 in 6,800... very few PT voters are red shirts and in fact hate their guts in most cases. So stop lying by fudging the figures to a massive extent.

Man of State merely 'and humbly' requested the military to have a look at a proposal to seek royal advice, they even went as far as to explicitly state that they were happy if it was rejected, and was only an opinion.... I don't recall them tacking on the end of their statement that everyone opposing their view should be destroyed. Another crazy embellishment from you that is quite bizarre.

Exposed to the full glare of the world's media eh?????

My friend just got here from the UK, he has no idea what is going on in Thailand. The world's media are anything but focusing on Thailand and its problems. As a matter of fact, I have all the UK mainstream channels here and the only mention Thailand gets is alongside a news report on a children's book reaching its 50th anniversary 'Mother Duck Goes To The Fair'... or something like that.

So you can stop being a drama queen and misinforming thaivisa members with stupid fake statements to give your post credence.

My question. Why is the PTP so insistent on a video conference instead of a face to face meeting? Makes me think they have some ulterior motive. Maybe so they can have other parties participate without the public seeing?

Maybe they are all hiding out in Dubai and Chiang Mai at this time. :)

Senate appointed Paiboon who went on air and press and proudly announced that he hate election. What is he doing in a chamber of a democratic system legislature. He should quit and be a full time activist for socialist reform.

When did the EC threaten TV stations? I never noticed any media reports about that.

Also, what does the fact that Megan Young from the Philippines is Miss World have to do with the situation in Thailand? Are you trying to claim that she is really Thai or something? Or do you think that Thaksin had something to do with her winning? Very confused here.

take it you missed the news on the EC threatening channel 11. Didn't look very well did you?

Be pedantic if you like, but everybody knew who I meant With the beauty pegeant girl who and you only got one like on a pretty shallow post didn't you. Which is more than you get on most of your nonsensical post.

You will remain confused as long as you refuse to open your ears and eyes.

Again another apologist who read only what he likes.

The 92 year old leader clearly said what I stated there, it was on here and in every other media. He said a PM should be apppointed and then any opposition destroyed. "crush those who dare" but the source is not quotable on here as it is not a hardline PDRC outlet!!!

Tell me which news media are not reporting on these issues and I'll have a look at them. Short list will do so we can look through their back log and see if you are right. easliy sorted so lets have the list please

Happy pedanting and was great to see 2 missguided individuals talk about miss philipines as if that in some way makes it ok. And also you appear to think 10,000 is an ok number to have executed.

You're entitled to you bizarre views, but I can assure you, you are in a very small minority.

Does anyone know which district this senator represents? When was he elected? And how many votes did he get? And when is he up for elections again?

there are lots of articles here in the United States. Everyone believes that the elections should go forward and it should be fought over what reforms to enact and who should do it. The results would serve as a referendum and show the will of the majority. Also everyone thinks that the opposition is a joke and we are all amaze what a mess they have made of the country.... Hope that helps.

Stop threatening each other and just sit down and agree on a way out of this mess.

Time to stop acting like spoiled brats and behaving like the statesmen your salary suggests you are.

Jon, this is difficult to understand, but I think you are up to it.

The process to end this can only happen if it could be ascertained that Caretaker MP Niwatthramung has the power to sign off and present for Royal endorsement as Acting, Caretaker PM to the EC to call for an election. but he doesn't seem to want to push too hard, given he would then be obligated to present Surachai as Deputy Senate Speaker for Royal Endorsement allowing the senate to open, with its first order of business to take a vote (60% majority needed) to ban YL, Niwatthramrung and several others pursuant to NACC indictments from politics for 5 years. Kind of a Catch 22.

Hence, if you have followed this, nobody is sure Niwatthamrung even has the power to call for an election or open the senate.

Instead, respecting each other, politics aside, they are trying to work their way out of this.

Perhaps he should issue a complaint against the Police for dereliction of duty, having failed to take him into custody to serve his prison sentence...!!

Is that this guy who was caught trying to bribe a court?
